00 HOUSE BILL NO. 340                                                                                                      
01 "An Act prohibiting the furlough of sex offenders."                                                                     
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 33.30.101 is amended by adding a new subsection to read:                                            
04  (c)  The regulations adopted under (a) of this section may not provide for the                                        
05 granting of a furlough of any type to a prisoner serving a sentence for violation of                                    
06 AS 11.41.410 - 11.41.470 unless                                                                                         
07   (1)  the furlough is for medical, psychiatric, or substance abuse                                                    
08 treatment and the furlough is to a secure, inpatient treatment facility and the                                         
09 commissioner finds that the furlough would not increase the risk of escape of the                                       
10 prisoner and harm to the public; or                                                                                     
11   (2)  the prisoner is at all times in the direct custody of a correctional                                            
12 officer while away from the correctional facility.
