SENATOR ADAMS moved that HB 180 am be passed out of committee with individual recommendations. SENATOR LEMAN objected for the purpose of considering a proposed amendment requested by the Kenai Builders' Association. SENATOR ADAMS withdrew his motion. DAVID HARDING, staff to Representative Eileen MacLean, related that the Alaska State Homebuilders, the Anchorage Home Builders, and several rural homebuilders are in support of the legislation without the amendment. Number 110 SENATOR RANDY PHILLIPS called for a hand vote on the adoption of Amendment No. 1. Senator Phillips voted for the amendment and Senators Zharoff, Leman and Adams voted against the amendment. Amendment No. 1 failed to be adopted. Number 122 SENATOR ADAMS moved that HB 180 am be moved out of committee with individual recommendations. Hearing no objection, it was so ordered. SENATOR RANDY PHILLIPS brought HB 89 (BOROUGH ASSEMBLY APPORTIONMENT) before the committee and asked for the pleasure of the committee. Number 130 SENATOR LEMAN moved that HB 89 and the accompanying zero fiscal note be passed out of committee with individual recommendations. Hearing no objection, it was so ordered. SENATOR RANDY PHILLIPS introduced SB 78 (DEADLINES FOR FUNDING EDUCATION) as the next order of business. LESLIE RIDLE, staff to Senator Little, was present to respond to questions. Number 170 SENATOR ZHAROFF moved that SB 78 be passed out of committee with individual recommendations. Hearing no objection, it was so ordered. SENATOR RANDY PHILLIPS brought SB 191 (MUNICIPAL PROPERTY TAX LIMITATIONS) before the committee and directed attention to a proposed committee substitute. SENATOR LEMAN moved that CSSB 191 (CRA) be adopted. SENATORS ZHAROFF and ADAMS objected. Number 215 CAROL CARROL, staff to Senator Jay Kerttula, said her understanding is that the committee substitute allows municipalities to exempt certain other entities from property tax, such as mobile home parks, recreational vehicle parks, parking lots, real property used for greenbelts, and the difference between improvements to a historical building and the assessed valuation that would add to the assessed valuation of a building beforehand. It also makes the local assessor bear the burden of proof instead of the individual taxpayer if they have some kind of conflict with the assessed value. She stated that Senator Kerttula does not have a position on the committee substitute. Number 232 SENATOR RANDY PHILLIPS suggested that because the committee substitute was recommended by Senator Taylor and he chairs the Judiciary Committee, which is the next committee of referral, the bill and the draft committee substitute be sent to that committee for further consideration. SENATOR LEMAN withdrew his motion to adopt CSSB 191 (CRA) and then moved to pass SB 191 out of committee with individual recommendations. Hearing no objection, it was so ordered. SENATOR RANDY PHILLIPS noted for the record that the concerns that Senator Taylor has and that he wanted added to this bill can be offered in the Judiciary Committee. SENATOR RANDY PHILLIPS brought SB 164 MUNICIPAL INCORPORATION, RECLASSIFICATION, DISSOLUTION) before the committee and directed attention to the most recent draft of a committee substitute, which had been adopted by the committee as a working document at a previous hearing. SENATOR LEMAN moved that CSSB 164(CRA) be passed out of committee with individual recommendations. Hearing no objection, it was so ordered.
