CHAIRMAN LEMAN brought SB 141 (CONCEALED HANDGUN PERMITS/FIREARM POSSESS) before the committee and directed attention to a proposed Rules CS. SENATOR TOGERSON moved the adoption of CSSB 141(RLS).  SENATOR DUNCAN objected and requested an explanation of the changes made in the committee substitute. TUCKERMAN BABCOCK , staff to Senator Lyda Green who sponsored the legislation, said the Rules CS clarifies actions taken by the Senate Finance Committee to prevent someone who is a repeat offender with a class A misdemeanor from applying for a permit if they have repeat offenses during a six-year period. Another change is to Section 15 which, as worded, was ambiguous and did not allow for a transition for a new resident who had a permit from another state, nor did it have a time limit on the number of days an individual could be in the state with an out-of-state permit. It now provides an individual can be in the state for 120 days with an out-of-state permit, which allows the individual to satisfy the 90-day requirement before applying for a new permit and allows the department to satisfy the 30-day requirement for issuing the permit. CHAIRMAN LEMAN asked if the objection to the adoption of the Rules CS was maintained, and it was not. He then stated CSSB 141(RLS) was adopted. SENATOR TORGERSON moved CSSB 141(RLS) be approved for calendaring at the discretion of the Chair. SENATOR DUNCAN objected. CHAIRMAN LEMAN stated the calendaring motion carried on a 3-1 vote.
