SB 100-MUNICIPAL LIENS: AUTHORITY FOR & PRIORITY  1:31:53 PM CHAIR LEDOUX announced that the only order of business would be SENATE BILL NO. 100, "An Act relating to municipal liens." 1:32:00 PM REPRESENTATIVE CLAMAN moved to adopt the House committee substitute (HCS) for SB 100, Version 30-LS0709\U, Shutts, 5/11/17, as a working document. There being no objection, Version U was before the committee. 1:32:31 PM COURTNEY ENRIGHT, Staff, Representative Gabrielle LeDoux, Alaska State Legislature, on behalf of Representative LeDoux, explained the changes to SB 100 proposed under Version U. First, Version U would allow a second-class borough to establish an emergency service area encompassing a state highway corridor and publicly owned property along it. Second, Version U would allow a municipality to provide a property tax exemption for a specified period, rather than five years at a time, and broaden the criteria for property that can get a tax exemption. Finally, Version U would change the property tax exemption for sprinkler systems from mandatory to optional. 1:33:44 PM REPRESENTATIVE EASTMAN moved to adopt Amendment 1, which read as follows: Page 4, line 2, following "fees": Insert "if the fees were accrued after the  municipality provided opportunity to opt out of the  utility service" REPRESENTATIVE CLAMAN objected. REPRESENTATIVE EASTMAN spoke to Amendment 1. He said there is a concern regarding the ability, under SB 100, of municipalities to put liens on properties for purposes of utilities, and he indicated this concern is accompanied by the opinion that municipalities should not be allowed to do so if a property owner has never used and has no intention of ever using the utility. He said Amendment 1 would provide the opportunity a property owner to declare he/she is not using a service and therefore does not want to pay for it. 1:34:54 PM REPRESENTATIVE CLAMAN maintained his objection. 1:34:59 PM A roll call vote was taken. Representative Eastman voted in favor of Amendment 1 to Version U. Representatives Stutes, Kito, Reinbold, Claman, and LeDoux voted against it. Therefore, Amendment 1 failed to be adopted by a vote of 1-5. 1:35:31 PM REPRESENTATIVE CLAMAN moved to report HCS for SB 100, Version 30-LS0709\U, Shutts, 5/11/17, out of committee with individual recommendations and the previous zero fiscal notes. There being no objection, HCS SB 100(RLS) was reported out of the House Rules Standing Committee.
