CHAIR CLAMAN called the Senate Judiciary Standing Committee
meeting to order at 1:30 p.m. Present at the call to order were
Senators Myers, Tobin, Stevens, and Chair Claman.
SB 17-CRIME COUNTERFEIT/NONFUNCTIONING AIRBAG

CHAIR CLAMAN announced the consideration of SENATE BILL NO. 17
"An Act establishing the crime of airbag fraud."
CHAIR CLAMAN said this is the second hearing of SB 17 in the
Senate Judiciary Committee. The intention is to consider a
committee substitute.

CHAIR CLAMAN solicited a motion.

SENATOR TOBIN moved to adopt the committee substitute (CS) for
SB 17, work order 34-LS0183\N, as the working document.

Summary of Changes
Senate Judiciary Committee: Version A to Version N
The Senate Judiciary Committee Substitute to SB 17
contains the following changes described below.
• Establishes an exemption for the crime of airbag
fraud for a person who discloses to the buyer or
lessee that the vehicle contains an airbag that is
inoperable, damaged, recalled, has previously been
deployed, causes a vehicle's diagnostic system to
inaccurately indicate that the vehicle is equipped
with a properly functioning airbag, or results in an
electric fault detected by a vehicle's diagnostic
system after the installation procedure was
completed before the sale lease, or trade of a
vehicle
• Clarifies the definition of a "nonfunctioning"
airbag to mean a replacement airbag in all cases.
