CHAIR MICCICHE announced  that the first order  of business would                                                               
be  SENATE BILL  NO. 193,  "An Act  relating to  liability of  an                                                               
electric  utility   for  contact   between  vegetation   and  the                                                               
utility's  facilities;  and  relating  to  vegetation  management

CHRISTIAN   ENGLISH,  Intern,   Senator  Coghill,   Alaska  State                                                               
Legislature, Juneau,  Alaska, said the committee  substitute (CS)                                                               
for SB  193 has two  major differences with the  original version                                                               
of  the  bill.  The  first difference  is  rather  than  amending                                                               
existing statute,  the CS creates  a new section that  allows for                                                               
the second  difference. The second  difference is the  CS expands                                                               
language  to clarify  the  idea behind  the  bill that  specifies                                                               
people only responsible for actions  that they have committed and                                                               
that is the whole goal behind the change.

RYNNIEVA MOSS, Staff, Senator  Coghill, Alaska State Legislature,                                                               
Juneau, Alaska, said Senator Kiehl  expressed concerns during the                                                               
previous hearing about  a scenario where a employee  of a utility                                                               
company goes on  private property with permission  and because of                                                               
their actions  removed vegetation from the  private property into                                                               
the right-of-way that  could cause damages where,  for example, a                                                               
large  tree falls  into  the  powerline and  starts  a fire.  She                                                               
specified that  [Section 1, AS 09.65.086(b)(2)(A)  and (b)(2)(B)]                                                               
addresses  Senator  Kiehl's concern  that  the  utility would  be                                                               
responsible for those actions.                                                                                                  
                                                                                                                                
She noted that  there was also concern about the  definition of a                                                               
vegetation  management plan.  She referenced  the Federal  Energy                                                               
Regulatory   Commission  (FERC)   that  specifies   each  utility                                                               
develops and  implements its own  vegetation management  plan due                                                               
to terrain and  climate variations. She noted  that Copper Valley                                                               
Electric Association testified at  the previous hearing that they                                                               
divide their vegetation plans into  northern and southern regions                                                               
due to growth differences.                                                                                                      
                                                                                                                                
She  said  in  researching  Senator Kiehl's  concerns  about  the                                                               
vegetation plan definition,  part of new legislation  from SB 123                                                               
provides   that  the   newly  established   electric  reliability                                                               
organization  (ERO)  has  the authority  to  establish  standards                                                               
including  a  vegetation management  plan.  She  said the  bill's                                                               
sponsor  feels that  the vegetation  management  plan fits  quite                                                               
well because the whole purpose  is to protect the reliability and                                                               
the safety of the utilities' electric facilities.                                                                               
                                                                                                                                
SENATOR KIEHL thanked the sponsor of  the bill for working on the                                                               
liability  issue that  he raised.  He said  he looked  forward to                                                               
reviewing  the  vegetation  management  plan  language  interface                                                               
between SB 193 and SB 123.
