Representative Petersen moved and asked unanimous consent that                                                                  
CSHB 280(FIN) be returned to second reading for the specific purpose                                                            
of considering Amendment No. 1.  There being no objection, it was so

    Insert "requiring the Regulatory Commission of Alaska to                                                                  
require a reduction in costs attributable to the application of                                                               
certain tax credits when determining rates;"

    Insert a new subsection to read:                                                                                            
         "(e)  In the establishment of rates to be paid by a consumer or                                                        
    customer under this chapter, the commission shall require that the                                                          
    reduction in costs attributable to credits authorized by                                                                    
    AS 43.20.046 and AS 43.55.023 be used to reduce a rate                                                                      
    determined by the commission. A credit under AS 43.55.023(a)                                                                
    for a qualified capital expenditure incurred in the Cook Inlet                                                              
    sedimentary basin or AS 43.55.023(m) for a Cook Inlet well lease                                                            
    expenditure shall be applied when determining the reduction in                                                              
    costs attributable to the credits, regardless of whether the credits                                                        
    were applied to a tax levied by AS 43.55.011(e) on a producer for                                                           
    oil or gas produced in the Cook Inlet sedimentary basin."
