The question being: "Shall Amendment No. 1 be adopted?" The roll was taken with the following result: SB 313 Second Reading Amendment No. 1 YEAS: 10 NAYS: 10 EXCUSED: 0 ABSENT: 0 Yeas: Donley, Duncan, Ellis, Halford, Jacko, Kerttula, Lincoln, Little, Salo, Zharoff Nays: Adams, Frank, Kelly, Leman, Miller, Pearce, Phillips, Rieger, Sharp, Taylor and so, Amendment No. 1 failed. Senator Duncan announced a minority caucus. RECESS Senator Taylor moved and asked unanimous consent that the Senate stand in recess to a call of the Chair. Without objection, the Senate recessed at 5:40 p.m. AFTER RECESS The Senate reconvened at 6:05 p.m. SB 313 Senators Rieger, Kelly offered Amendment No. 2 : Page 1, line 1, after "Act": Insert "prohibiting a civil action based on professional negligence against a health care provider by a person who on the date of the negligent act or omission is less than two years of age, unless the action is brought before the person's eighth birthday;"
