00 SENATE BILL NO. 243 01 "An Act relating to the board of directors of the Alaska Energy Authority." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 44.83.030 is amended to read: 04 Sec. 44.83.030. Membership of the authority. The directors of the authority 05 [ALASKA ENERGY AUTHORITY] are 06 (1) the commissioner of revenue; 07 (2) the commissioner of commerce, community, and economic 08 development; and 09 (3) six public members appointed by the governor as follows: 10 (A) one member with expertise or experience in managing 11 or operating an electric utility that is not connected to an interconnected 12 electric energy transmission network as defined in AS 42.05.790; 13 (B) one member with expertise or experience in developing 14 energy projects in rural communities; 15 (C) one member with expertise or experience in managing

01 or operating an electric utility connected to an interconnected electric 02 energy transmission network as defined in AS 42.05.790; 03 (D) one member with financial expertise in large-scale 04 energy project development; and 05 (E) two members with expertise or experience in finance, 06 energy policy, energy technology, engineering, law, or economics [THE 07 MEMBERS OF THE ALASKA INDUSTRIAL DEVELOPMENT AND 08 EXPORT AUTHORITY]. 09 * Sec. 2. AS 44.83.030 is amended by adding new subsections to read: 10 (b) If the commissioner described in (a)(1) or (a)(2) of this section is unable to 11 attend a meeting of the authority, the commissioner may, by an instrument in writing 12 filed with the authority, designate a deputy or assistant to act in the commissioner's 13 place as a member at the meeting. For all purposes of this chapter, the designee is a 14 member of the authority at the meeting. 15 (c) Public members of the authority described in (a)(3) of this section serve for 16 three-year terms. 17 (d) If a vacancy occurs in the membership of the authority, the governor shall 18 immediately appoint a member for the unexpired portion of the term. 19 * Sec. 3. AS 44.83.040(a) is amended to read: 20 (a) The authority shall elect a chair and vice-chair every two years from 21 among its directors [OF THE ALASKA INDUSTRIAL DEVELOPMENT AND 22 EXPORT AUTHORITY SHALL SERVE AS OFFICERS OF THE ALASKA 23 ENERGY AUTHORITY]. The powers of the authority [ALASKA ENERGY 24 AUTHORITY] are vested in the directors, and five [FOUR] directors of the authority 25 constitute a quorum. Action may be taken and motions and resolutions adopted by the 26 authority [ALASKA ENERGY AUTHORITY] at a meeting by the affirmative vote 27 of at least five [A MAJORITY] of the directors. The directors of the authority 28 [ALASKA ENERGY AUTHORITY] serve without compensation, but they shall 29 receive the same travel pay and per diem as provided by law for board members under 30 AS 39.20.180. 31 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to

01 read: 02 TRANSITION. Notwithstanding AS 44.83.030(c), added by sec. 2 of this Act, the 03 governor shall appoint two public members of the initial Alaska Energy Authority board of 04 directors to one-year terms, two public members to two-year terms, and two public members 05 to three-year terms.
