00 SENATE BILL NO. 236 01 "An Act relating to grants to disaster victims." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 26.23.090(b) is repealed and reenacted to read: 04 (b) When the President declares a major disaster, the governor may make a 05 financial grant to an individual or family to meet disaster-related necessary expenses 06 or serious needs of the individual or family adversely affected by the disaster that 07 cannot otherwise adequately be met from other means of assistance. The governor 08 may make a grant under this subsection to an individual or family in an amount whose 09 total of federal and state shares does not exceed the maximum amount authorized by 10 42 U.S.C. 5174(h) for grants payable to individuals and families. 11 * Sec. 2. AS 26.23.090 is amended by adding a new subsection to read: 12 (d) When the President does not declare a major disaster but the governor 13 declares a disaster emergency, the governor may make a financial grant to an 14 individual or family to meet disaster-related necessary expenses or serious needs of 15 the individual or family adversely affected by the disaster that cannot otherwise

01 adequately be met from other means of assistance. The governor may make a grant 02 under this subsection to an individual or family in an amount not to exceed the greater 03 of $50,000 or one-half of the maximum amount authorized by 42 U.S.C. 5174(h) for 04 grants payable to individuals and families. An individual or family that is a unit owner 05 may use a grant made to the unit owner under this subsection to meet the unit's 06 common expense liability that is associated with the disaster. In this subsection, 07 "common expense liability," "unit," and "unit owner" have the meanings given in 08 AS 34.08.990.
