01 "An Act relating to the Regulatory Commission of Alaska and regulation of the service                                   
02 of natural gas storage."                                                                                                
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 42.05.141 is amended by adding new subsections to read:                                            
05 (g)  Except as provided in AS 42.05.711(q) and (s), the commission shall                                                
06 regulate under this chapter the service of natural gas storage and the service of                                       
07 liquefied natural gas storage, including storage furnished by operating a natural gas                                   
08       storage facility that is part of a                                                                                
09                 (1)  pipeline facility operated by a pipeline carrier; or                                               
10                 (2)  natural gas pipeline facility operated by a natural gas pipeline                                   
11       carrier.                                                                                                          
12            (h)  In (g) of this section, "natural gas pipeline carrier," "natural gas pipeline                           
13       facility," "pipeline carrier," and "pipeline facility" have the meanings given in                                 
14       AS 42.06.630.                                                                                                     

01    * Sec. 2. AS 42.05.711(q) is amended to read:                                                                      
02 (q)  The service of natural gas storage furnished by operating a natural gas                                            
03 storage facility that is [(1) PART OF A PIPELINE FACILITY OPERATED BY A                                                 
04 PIPELINE CARRIER, (2) PART OF A NATURAL GAS PIPELINE FACILITY                                                           
05 OPERATED BY A NATURAL GAS PIPELINE CARRIER, OR (3)] part of a North                                                     
06 Slope natural gas pipeline facility operated by a North Slope natural gas pipeline                                      
07 carrier is exempt from this chapter. In this subsection, ["NATURAL GAS PIPELINE                                         
08 CARRIER," "NATURAL GAS PIPELINE FACILITY,"] "North Slope natural gas                                                    
09 pipeline carrier [,]" and "North Slope natural gas pipeline facility [,]" ["PIPELINE                                
10 CARRIER," AND "PIPELINE FACILITY"] have the meanings given in                                                           
11       AS 42.06.630.                                                                                                     
12    * Sec. 3. AS 42.06.140 is amended by adding new subsections to read:                                               
13 (c)  The commission shall regulate under AS 42.05 the service of natural gas                                            
14 and liquefied natural gas storage, including storage furnished by operating a natural                                   
15       gas storage facility that is part of a                                                                            
16                 (1)  pipeline facility operated by a pipeline carrier; or                                               
17 (2)  natural gas pipeline facility operated by a natural gas pipeline                                                   
18       carrier.                                                                                                          
19            (d)  In this section,                                                                                        
20 (1)  "service of liquefied natural gas storage" means the operation of a                                                
21 liquefied natural gas storage facility; "service of liquefied natural gas storage" does                                 
22       not include the storage of liquefied natural gas                                                                  
23 (A)  owned by or contractually obligated to the owner, operator,                                                        
24            or manager of the liquefied natural gas storage facility; or                                               
25                      (B)  for which the price of storage is not separately itemized;                                    
26 (2)  "service of natural gas storage" means the operation of a natural                                                  
27 gas storage facility primarily or exclusively for the benefit of third-party customers,                                 
28 and not for the benefit of the owner, operator, or manager of the natural gas storage                                   
29       facility; "service of natural gas storage" does not include the storage of natural gas                            
30 (A)  owned by or contractually obligated to the owner, operator,                                                        
31            or manager of the natural gas storage facility; or                                                         

01                      (B)  for which the price of storage is not separately itemized.                                    
02    * Sec. 4. AS 42.05.990(10)(B) and AS 42.05.990(11)(B) are repealed.
