00 SPONSOR SUBSTITUTE FOR SENATE BILL NO. 218 01 "An Act relating to vehicle weight limits; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 19.10.060 is amended by adding new subsections to read: 04 (d) Except as provided in AS 19.10.065 and (e) of this section, the loaded 05 gross weight of a vehicle or combination of vehicles on a highway under the 06 department's jurisdiction may not exceed 140,000 pounds without a permit issued in 07 accordance with this section. 08 (e) A vehicle or combination of vehicles is not subject to (d) of this section if 09 the only cargo being transported by the vehicle or combination of vehicles is 10 (1) food for human consumption; or 11 (2) refined fuel. 12 (f) The department shall charge a fee for a permit to exceed the weight in (d) 13 of this section to offset the costs to the state to keep the roadway surface and other 14 roadway structures, including bridges, in a condition to accommodate heavy loads and 15 the administrative costs related to issuing the permits and conducting enforcement.

01 The department shall calculate the permit fee based on the criteria in this subsection, 02 the vehicle's equivalent single axle load, and the distance traveled. In this subsection, 03 "equivalent single axle load" means the amount of damage to highway pavement 04 structures equivalent to one pass of a single 18,000-pound dual-tire axle with all four 05 tires on the axle inflated to 110 pounds per square inch. 06 * Sec. 2. AS 19.10.065(a) is amended to read: 07 (a) Implements of husbandry, as defined by regulation under AS 28.05.011, 08 are not subject to restrictions adopted under AS 19.10.060(a)(1) or the weight limit in 09 AS 19.10.060(d) unless the implement is the load of another vehicle. Implements of 10 husbandry may be operated on highways subject to the department's jurisdiction 11 without obtaining a permit, as provided in this section. 12 * Sec. 3. AS 45.75.131(a) is amended to read: 13 (a) A peace officer or an employee of the Department of Transportation and 14 Public Facilities who is authorized by the commissioner of transportation and public 15 facilities to enforce this chapter may issue a citation to a person who 16 (1) violates a weight, size, or load limitation adopted by the 17 Department of Transportation and Public Facilities under AS 19.10.060; 18 (2) violates the terms of an overweight or oversize vehicle permit 19 issued under AS 19.10.060 [AS 19.10.060(b)]; 20 (3) violates a regulation adopted under AS 19.10.060(b) or (c), 21 AS 28.05.011(a)(2), or AS 45.75.050(b)(5); 22 (4) violates the weight limit in AS 19.10.060(d); or 23 (5) [(4)] commits a violation identified under AS 45.75.380. 24 * Sec. 4. This Act takes effect June 30, 2024.
