00 CS FOR SENATE BILL NO. 95(STA) 01 "An Act relating to special request specialty organization registration plates; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 28.10.181 is amended by adding a new subsection to read: 05 (ll) Special request specialty organization plates. The department shall adopt 06 regulations to allow for the issuance of special request specialty organization 07 registration plates sponsored by an organization that is based in this state and is tax 08 exempt under 26 U.S.C. 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - 09 (29), is an Alaska chapter of a national organization that is tax exempt under 26 U.S.C. 10 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - (29), is a department of 11 the state, or is a municipality of the state. The department shall determine a common 12 design and color for the plates and provide for the placement of the logo of the 13 organization and a short piece of descriptive text on the plate. If the department denies 14 an application to create a specialty organization registration plate under this section,
01 the department shall notify the commissioner of the denial. The commissioner may 02 reverse the decision of the department and require issuance of the requested plate. The 03 department may disapprove the issuance of registration plates under this subsection 04 when the requested plates duplicate an existing registration. Regulations adopted 05 under this subsection must 06 (1) provide that the entity requesting the issuance of the plates 07 (A) submit an application on a form provided by the 08 department; 09 (B) pay an application fee set by the department for issuance of 10 the new registration plates; 11 (C) pay the entire cost of developing and issuing the specialty 12 plate; 13 (D) may not be offensive in purpose, nature, activity, or name; 14 (E) may charge a fee for issuance of a specialty registration 15 plate in addition to any registration fees set by statute or regulation; 16 (2) provide for notice to the entity sponsoring the plate not later than 17 six months before a proposed cancellation of the specialty organization plate; 18 (3) establish procedures for owners of vehicles to purchase specialty 19 organization registration plates under this subsection. 20 * Sec. 2. AS 28.10.421(d) is amended by adding a new paragraph to read: 21 (26) special request specialty organization plates under 22 AS 28.10.181(ll) ........................................ $100 23 plus the fee required for that vehicle under (b), (c), (h), or (i) of this section; the $100 24 fee required by this paragraph shall be collected only on the first issuance of and the 25 replacement of the plates; in addition, an entity sponsoring a special request specialty 26 organization plate may charge a fee on first issuance and renewal of the plates. 27 * Sec. 3. This Act takes effect January 1, 2024.
