00 CS FOR HOUSE BILL NO. 397(STA) 01 "An Act relating to eliminating vacant positions in the classified and partially exempt 02 service of the state; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 39.25 is amended by adding a new section to read: 05 Sec. 39.25.156. Elimination of vacant positions. On June 30 of each odd- 06 numbered year, the director of personnel shall eliminate a position in the classified or 07 partially exempt service that has been vacant for the immediately preceding 728-day 08 period. For purposes of this section, a position is not vacant if a full-time, part-time, 09 temporary, permanent, or nonpermanent employee 10 (1) is occupying the position; 11 (2) occupied the position at any time during the immediately preceding 12 728-day period; 13 (3) has been hired during the immediately preceding 728-day period to 14 occupy the position, even if the employment begins in the following fiscal year; or

01 (4) may be eligible to return to the position under AS 39.25.158. 02 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 03 read: 04 APPLICABILITY. This Act applies to contracts that take effect after June 30, 2024. 05 * Sec. 3. This Act takes effect July 1, 2024.
