01 "An Act relating to the reimbursement rate for prisoner medical care."                                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 33.30.028 is amended by adding a new subsection to read:                                           
04 (e)  The rate of reimbursement by the department to a provider for prisoner                                             
05 medical care costs may not exceed the Medicaid reimbursement rate established under                                     
06 42 U.S.C. 1396 - 1396w-7 (Title XIX, Social Security Act) unless the commissioner                                       
07 enters into a contract for a higher rate of reimbursement. In this subsection, "medical                                 
08 care costs" does not include the cost of psychological or psychiatric care provided to a                                
09       prisoner.                                                                                                         
10    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
11 read:                                                                                                                   
12       APPLICABILITY. AS 33.30.028(e), enacted by sec. 1 of this Act, applies to medical                                 
13 care costs incurred on or after the effective date of this Act.
