00 HOUSE BILL NO. 361 01 "An Act relating to the medical assistance program and mental health or substance use 02 disorder benefit requirements; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.07.030 is amended by adding a new subsection to read: 05 (i) In providing the services required under this section, the department shall 06 comply with the mental health or substance use disorder benefit requirements 07 established under 26 U.S.C. 9812, 29 U.S.C. 1185a, and 42 U.S.C. 300gg-26. 08 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 09 read: 10 MEDICAID STATE PLAN. The Department of Health shall submit as necessary for 11 approval by the United States Department of Health and Human Services amendments to the 12 state plan under AS 47.07.040 to comply with the mental health or substance use disorder 13 benefit requirements established under 26 U.S.C. 9812, 29 U.S.C. 1185a, and 42 U.S.C. 14 300gg-26.
01 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 02 read: 03 CONDITIONAL EFFECT; NOTIFICATION. (a) Section 1 of this Act takes effect 04 only if, and to the extent that, the United States Department of Health and Human Services 05 approves amendments submitted in accordance with sec. 2 of this Act. 06 (b) The commissioner of health shall notify the revisor of statutes in writing within 30 07 days after the United States Department of Health and Human Services approves amendments 08 to the state plan. 09 * Sec. 4. If sec. 1 of this Act takes effect, it takes effect the day after the United States 10 Department of Health and Human Services approves the amendment to the state plan under 11 sec. 3 of this Act.
