00 HOUSE BILL NO. 326 01 "An Act relating to cross-deputization agreements with federally recognized tribes and 02 peace officers employed by federally recognized tribes." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.65 is amended by adding a new section to read: 05 Article 9A. Cross-Deputization Agreements. 06 Sec. 18.65.690. Cross-deputization agreements. (a) The Department of 07 Public Safety or a municipal police force may enter into a cross-deputization 08 agreement with a federally recognized tribe or a peace officer employed by a federally 09 recognized tribe who is not employed as a village or regional public safety officer 10 under AS 18.65.670 - 18.65.688 only if the agreement does not grant an expansion of 11 the tribe's or peace officer's criminal jurisdiction or authority over nontribal members 12 on nontribal land. 13 (b) Notwithstanding (a) of this section, the Department of Public Safety and 14 members of the state troopers may command assistance from a tribal peace officer

01 under AS 18.65.100. 02 (c) In this section, 03 (1) "cross-deputization agreement" means an agreement that authorizes 04 peace officers employed by a federally recognized tribe to enforce state, municipal, 05 and tribal criminal law outside of the tribe's criminal jurisdiction; 06 (2) "federally recognized tribe" has the meaning given in 07 AS 23.20.520. 08 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 09 read: 10 APPLICABILITY. AS 18.65.690, enacted by sec. 1 of this Act, applies to cross- 11 deputization agreements entered into on or after the effective date of this Act.
