00 HOUSE BILL NO. 279 01 "An Act relating to the Local Boundary Commission; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.33.810 is amended to read: 05 Sec. 44.33.810. Local Boundary Commission. There is in the Department of 06 Commerce, Community, and Economic Development a Local Boundary Commission. 07 The Local Boundary Commission consists of five members appointed by the governor 08 for overlapping five-year terms. One member shall be appointed from each of the four 09 judicial districts described in AS 22.10.010 and one member shall be appointed from 10 the unorganized borough. The members from each judicial district must 11 maintain a principal place of abode and be registered to vote in a precinct in that 12 district. The governor shall designate one member as [STATE AT LARGE. THE 13 MEMBER APPOINTED FROM THE STATE AT LARGE IS] the chair of the 14 commission.

01 * Sec. 2. AS 44.33.812(a) is amended to read: 02 (a) The Local Boundary Commission shall 03 (1) make studies of local government boundary problems; 04 (2) adopt regulations providing standards and procedures for municipal 05 incorporation, annexation, detachment, merger, consolidation, reclassification, and 06 dissolution; the regulations providing standards and procedures are subject to 07 AS 29.04 - AS 29.10; 08 (3) consider a local government boundary change requested of it by the 09 legislature, the commissioner of commerce, community, and economic development, 10 or a political subdivision of the state; "boundary change" may not be construed to 11 include a borough incorporation; [AND] 12 (4) develop standards and procedures for the extension of services and 13 ordinances of incorporated cities into contiguous areas for limited purposes upon 14 majority approval of the voters of the contiguous area to be annexed and prepare 15 transition schedules and prorated tax mill levies as well as standards for participation 16 by voters of these contiguous areas in the affairs of the incorporated cities furnishing 17 services; and 18 (5) maintain, for each community in the state, a record of that 19 community's population according to the most recent decennial census conducted 20 by the United States Bureau of the Census. 21 * Sec. 3. This Act takes effect January 31, 2025.
