00 HOUSE BILL NO. 256 01 "An Act relating to closure of plants and facilities of a public utility and discontinuance, 02 abandonment, or suspension of a public utility service." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 42.30 is amended by adding a new section to read: 05 Article 7. Closure of Public Utility Plants or Facilities. 06 Sec. 42.30.500. Closure of public utility plants or facilities. (a) 07 Notwithstanding AS 10.25 and AS 42.05.261, a public utility may not close a plant or 08 facility constructed, in whole or in part, using state funding unless 09 (1) the public utility first offers to sell the plant or facility to another 10 public utility; and 11 (2) the legislature approves the closure of the plant or facility. 12 (b) In this section, "public utility" includes every corporation whether public, 13 cooperative, or otherwise, company, individual, or association of individuals, their 14 lessees, trustees, or receivers appointed by a court, that owns, operates, manages, or
01 controls any plant or facility for furnishing, by generation, transmission, or 02 distribution, electrical service to the public for compensation.
