00 HOUSE BILL NO. 210 01 "An Act relating to voting machines and vote tally systems; and relating to ballots." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 15.15.030 is amended by adding a new paragraph to read: 04 (18) Official ballots must be printed in the United States on paper 05 manufactured in the United States. 06 * Sec. 2. AS 15.20.910 is amended to read: 07 Sec. 15.20.910. Standards for voting machines and vote tally systems. The 08 director may approve a voting machine or vote tally system for use in an election in 09 the state based on [UPON CONSIDERATION OF] factors relevant to the 10 administration of state elections, including whether the Federal Election Commission 11 has certified that the voting machine or vote tally system complies [TO BE IN 12 COMPLIANCE] with the voting system standards approved by the Federal Election 13 Commission as required by 42 U.S.C. 15481(a)(5) (Help America Vote Act of 2002). 14 A [THE DIRECTOR MAY ONLY APPROVE A] voting machine or vote tally system 15 must

01 (1) satisfy [IF THE MACHINE OR SYSTEM SATISFIES] the 02 requirements of AS 15.15.032(c); and 03 (2) be manufactured in the United States by a corporation or 04 entity owned or controlled by citizens of the United States that employs and 05 contracts only with citizens of the United States and does not employ or contract 06 with an individual convicted of a felony under AS 15.56 or a similar state or 07 federal election law. 08 * Sec. 3. AS 15.20.910 is amended by adding new subsections to read: 09 (b) The director shall maintain a list of each voting machine and vote tally 10 system approved under (a) of this section. 11 (c) Before using a voting machine or vote tally system for an election, the 12 director shall, at least 180 days before voting begins, provide public notice that the 13 division intends to use the voting machine or vote tally system for the election. 14 (d) A resident of this state has standing to apply to the superior court to 15 compel the director to comply with this section. 16 * Sec. 5. AS 29.26 is amended by adding a new section to article 1 to read: 17 Sec. 29.26.080. Voting machines and vote tally systems. (a) A governing 18 body may use a voting machine or vote tally system for a municipal election. The 19 voting machine or vote tally system must be approved by the director of elections 20 under AS 15.20.910. 21 (b) At least 180 days before voting begins, the governing body shall provide 22 public notice that the municipality intends to use the voting machine or vote tally 23 system for the election.
