00 HOUSE BILL NO. 202 01 "An Act relating to the availability and administration of opioid overdose drugs in 02 public schools." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.30 is amended by adding a new section to article 3 to read: 05 Sec. 14.30.145. Opioid overdose drugs. (a) Each school district shall ensure 06 that 07 (1) a person trained to administer naloxone nasal spray is on site 08 (A) when the main school building of each school in the school 09 district is open to students, staff, or the public, including periods when the 10 school building is open before and after school hours and during weekend 11 activities; and 12 (B) during each school-sponsored event, whether the event is 13 conducted on or off of school grounds; 14 (2) each school bus driver for the school district is trained to

01 administer naloxone nasal spray; 02 (3) the main school building of each school in the school district has at 03 least two doses of naloxone nasal spray available on site; and 04 (4) at least one dose of naloxone nasal spray is available during a 05 school-sponsored event, whether the event is conducted on or off of school grounds, 06 and on a school bus while students are being transported to or from school or a school- 07 sponsored event. 08 (b) The commissioner of health shall develop and provide to each school 09 district a short training video about how and when to administer naloxone nasal spray. 10 (c) In this section, 11 (1) "main school building" means the building on school grounds 12 where most of the students of the school are educated during regular school hours and 13 the principal, nurse, and other administrative staff of the school are located; 14 (2) "naloxone nasal spray" has the meaning given in AS 17.20.085(e); 15 (3) "opioid overdose drug" has the meaning given in AS 17.20.085(e); 16 (4) "school district" means a borough school district, a city school 17 district, a regional educational attendance area, and a state boarding school; 18 (5) "school grounds" means a building, structure, athletic playing field, 19 playground, parking area, or land contained within the real property boundary line of a 20 school in a school district. 21 * Sec. 2. AS 17.20.085(e) is amended by adding new paragraphs to read: 22 (5) "naloxone nasal spray" means naloxone administered by intranasal 23 spray that reverses, in whole or in part, the pharmacological effects of an opioid 24 overdose; 25 (6) "school district" has the meaning given in AS 14.30.145(c). 26 * Sec. 3. AS 17.20.085 is amended by adding new subsections to read: 27 (f) Notwithstanding a provision or rule of law to the contrary, a school district, 28 if acting under a standing order or protocol under (a) or (c) of this section, may receive 29 a supply of opioid overdose drugs and possess opioid overdose drugs for the purposes 30 of AS 14.30.145. 31 (g) Notwithstanding a provision or rule of law to the contrary, a person, if

01 acting under a standing order or protocol under (a) or (c) of this section, may 02 administer naloxone nasal spray under AS 14.30.145 to a person at risk of 03 experiencing an opioid overdose.
