00 HOUSE BILL NO. 131 01 "An Act relating to voting machines and vote tally systems; and providing for an 02 effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 15.20.910 is amended to read: 05 Sec. 15.20.910. Standards for voting machines and vote tally systems. The 06 director may approve a voting machine or vote tally system for use in an election in 07 the state upon consideration of factors relevant to the administration of state elections, 08 including whether the [FEDERAL ELECTION COMMISSION HAS CERTIFIED 09 THE VOTING MACHINE OR VOTE TALLY SYSTEM TO BE IN COMPLIANCE 10 WITH THE VOTING SYSTEM STANDARDS APPROVED BY THE FEDERAL 11 ELECTION COMMISSION AS REQUIRED BY 42 U.S.C. 15481(a)(5) (HELP 12 AMERICA VOTE ACT OF 2002). THE DIRECTOR MAY ONLY APPROVE A] 13 voting machine or vote tally system meets the United States Election Assistance 14 Commission's voluntary voting system guidelines and is certified by the

01 commission. A voting machine or vote tally system must use only open-source 02 software technology and satisfy [IF THE MACHINE OR SYSTEM SATISFIES] the 03 requirements of AS 15.15.032(c). 04 * Sec. 2. AS 15.20.910 is amended by adding a new subsection to read: 05 (b) In this section, "open-source software technology" means the complete 06 source code for the software is available to the public, under the terms of a license, to 07 use, modify, or distribute freely without payment of royalties or other consideration. 08 * Sec. 3. This Act takes effect July 1, 2023.
