01 "An Act relating to microreactors."                                                                                     
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 18.45.025 is amended by adding a new subsection to read:                                          
04            (d)  Notwithstanding (b) of this section, a person that is otherwise compliant                               
05       with this chapter may construct a microreactor on land that has not been designated by                            
06       the legislature.                                                                                                  
07    * Sec. 2.  AS 18.45.030 is amended by adding a new subsection to read:                                             
08            (b)  The requirements set out under (a) of this section do not apply to the                                  
09       presence of microreactors in the state.                                                                         
10    * Sec. 3.  AS 18.45.900 is amended by adding a new paragraph to read:                                              
11                 (9)  "microreactor" means a nuclear utilization facility that                                           
12                      (A)  is a nuclear fission reactor consistent with the definition of                                
13            "advanced nuclear reactor" in 42 U.S.C. 16271; and                                                           
14                      (B)  is capable of generating no more than 50 megawatts of                                         
15            electric energy.
