00 SENATE BILL NO. 118 01 "An Act establishing the committee on nullification of federal laws; and providing a 02 directive to the lieutenant governor." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 24.20 is amended by adding a new section to read: 05 Article 4. Committee on Nullification of Federal Laws. 06 Sec. 24.20.700. Committee on nullification of federal laws established; 07 duties. (a) The committee on nullification of federal laws is established as a 08 permanent interim committee of the legislature. 09 (b) The committee is composed of 10 (1) the president of the senate, or the president's designee; 11 (2) six members of the senate, appointed by the president of the senate, 12 with not more than four members being members of the same political party; 13 (3) the speaker of the house of representatives, or the speaker's 14 designee; and

01 (4) six members of the house of representatives, appointed by the 02 speaker of the house, with not more than four members being members of the same 03 political party. 04 (c) The president of the senate and the speaker of the house of representatives 05 shall serve as co-chairs of the committee. 06 (d) Each committee member shall serve a two-year term, coinciding with the 07 beginning and end of the regular session of the legislature each odd- numbered year. 08 (e) The committee shall meet at the call of either co-chair. 09 (f) Upon receipt of a federal statute, regulation, or an executive order for 10 consideration and process, the committee shall recommend whether to nullify in its 11 entirety a specific federal statute, regulation, or executive order. In making its 12 recommendation, the committee shall consider whether the statute, regulation, or 13 executive order is outside the scope of the powers delegated to the federal government 14 in the Constitution of the United States. 15 (g) The committee may review existing federal statutes, regulations, and 16 executive orders enacted before the effective date of this section for the purpose of 17 determining constitutionality and shall recommend whether to nullify in its entirety a 18 specific federal statute, regulation, or executive order. 19 (h) Upon the committee's recommendation, the legislature, by concurrent 20 resolution, may consider whether to nullify the federal action. 21 (i) If the legislature adopts a concurrent resolution to nullify a federal statute, 22 regulation, or executive order based on constitutionality by a majority of the 23 membership of each house, the state and the citizens of the state may not recognize or 24 be obligated to abide by the federal law or executive order. 25 * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 26 read: 27 DIRECTIVE. The lieutenant governor shall forward a copy of the enrolled version of 28 this bill to the President of the United States, the president of the United States Senate, the 29 speaker of the United States House of Representatives, and each member of the Alaska 30 congressional delegation.
