00 HOUSE CS FOR CS FOR SENATE BILL NO. 95(STA) 01 "An Act relating to the right of first refusal of a volunteer search and rescue group with 02 respect to obsolete or surplus state property." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. The uncodified law of the State of Alaska is amended by adding a new section 05 to read: 06 SHORT TITLE. This Act may be known as the Ellie Mae Act. 07 * Sec. 2. AS 44.68.110 is amended by adding a new subsection to read: 08 (c) A group of volunteers that is organized to provide search and rescue 09 services in the state, including participation in a search and rescue party under 10 AS 18.60.120, may exercise a right of first refusal with respect to obsolete or surplus 11 state property that may assist in carrying out search and rescue services before the 12 property is sold, leased, licensed, or disposed of under (a) of this section. To qualify 13 under this subsection, the group shall be organized as a nonprofit corporation under 14 AS 10.20 or exercise the right of first refusal through and in the name of the 15 municipality in which the group is located or a Native village council operating in the

01 area in which the group is located that agrees to accept the property and use the 02 property for search and rescue services. If the group exercises the right of first refusal 03 through and in the name of a municipality or Native village council, the municipality 04 or Native village council shall own the property. The Department of Administration 05 shall provide public notice of the availability of obsolete or surplus state property that 06 may assist in carrying out search and rescue services before the property is sold, 07 leased, licensed, or disposed of under (a) of this section, as provided by regulation. In 08 this subsection, "search and rescue services" means a search for a person who is lost, 09 injured, killed, or in need of immediate rescue, the provision of aid to a person who is 10 in distress or in immediate danger, or the retrieval of a person's remains.
