00 HOUSE BILL NO. 407 01 "An Act relating to commerce with Russia; relating to the use of the ports in the state; 02 and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 30.50 is amended by adding a new section to read: 05 Sec. 30.50.030. Ban on use of ports in the state. Notwithstanding any other 06 provision of law, a ship may not dock at a port in the state if the ship 07 (1) is operated or owned in whole or in part by Russia or by a citizen 08 or organization of Russia; or 09 (2) carries cargo that is grown or produced by Russia or by a citizen or 10 organization of Russia. 11 * Sec. 2. AS 45.45 is amended by adding a new section to read: 12 Sec. 45.45.940. Ban on commerce with Russia. Notwithstanding any other 13 provision of law, a person or a governmental agency may not export an item from the 14 state to Russia or import an item to the state from Russia. In this section,

01 (1) "fish" has the meaning given in AS 16.05.940; 02 (2) "governmental agency" means the state, an agency of the state, a 03 municipality, or an agency of a municipality; 04 (3) "item" includes fish, alcoholic beverages, petroleum, and natural 05 gas. 06 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 07 read: 08 APPLICABILITY. (a) AS 30.50.030, enacted by sec. 1 of this Act, does not apply to 09 the docking of a ship operated or owned by Russia or a ship that carries cargo grown or 10 produced by Russia if a contract for the docking was entered into before the effective date of 11 sec. 1 of this Act. 12 (b) AS 45.45.940, enacted by sec. 2 of this Act, does not apply to the export or import 13 of an item if a contract for the export or import of the item was entered into before the 14 effective date of sec. 2 of this Act. In this section, "item" has the meaning given in 15 AS 45.45.940, enacted by sec. 2 of this Act. 16 * Sec. 4. AS 30.50.030 and AS 45.45.940 are repealed. 17 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 18 read: 19 CONDITIONAL EFFECT; NOTIFICATION OF REVISOR OF STATUTES. (a) 20 Section 4 of this Act takes effect only if, before July 1, 2032, the United States government 21 lifts all of its sanctions against Russia arising out of the threatened or actual invasion of 22 Ukraine. 23 (b) If the United States government lifts all of its sanctions against Russia arising out 24 of the threatened or actual invasion of Ukraine, the commissioner of commerce, community, 25 and economic development shall notify the revisor of statutes not later than 30 days after 26 receiving notice that the sanctions have been lifted. 27 * Sec. 6. If, under sec. 5(a) of this Act, sec. 4 of this Act takes effect, it takes effect on the 28 earlier of 29 (1) July 1, 2032; or 30 (2) the day after the date on which the commissioner of commerce, 31 community, and economic development notifies the revisor of statutes under sec. 5(b) of this

01 Act. 02 * Sec. 7. Except as provided in sec. 6 of this Act, this Act takes effect immediately under 03 AS 01.10.070(c).
