01 "An Act relating to village safe water and hygienic sewage disposal facilities."                                        
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 46.07.040 is amended by adding a new subsection to read:                                             
04            (d)  The commissioner may not consider the following a prerequisite to fund or                               
05       construct a facility:                                                                                             
06                 (1)  the financial, managerial, and technical capability of a village to                                
07       safely operate and maintain the facility;                                                                         
08                 (2)  the affordability and sustainability of safely operating and                                       
09       maintaining the proposed facility.
