01 "An Act relating to exemptions from minimum wage."                                                                      
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 23.10.070 is amended to read:                                                                      
04 Sec. 23.10.070. Exemptions from minimum wage. To the extent necessary to                                              
05 prevent curtailment of opportunities of employment, the commissioner may by                                             
06 regulations or orders provide for the employment at wages lower than the minimum                                        
07       wage prescribed in AS 23.10.050 - 23.10.150 of                                                                    
08                 (1)  an individual under 18 years of age who is temporarily                                         
09       employed by a nonprofit organization that is exempt under 26 U.S.C. 501(c)(3)                                 
10       [WHOSE EARNING CAPACITY IS IMPAIRED BY PHYSICAL OR MENTAL                                                         
11       DEFICIENCY, AGE, OR INJURY], at the wages and subject to the restrictions and                                     
12       for the period of time that are fixed by the commissioner; [AND]                                                  
13                 (2)  an apprentice at the wages that are approved by the commissioner;                                  
14       or                                                                                                                
15                 (3)  a learner at the wages and subject to the restrictions and for the                                 

01       periods of time that are fixed by the commissioner.
