01 "An Act relating to the confidentiality of certain state records relating to animals; and                               
02 providing for an effective date."                                                                                       
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 03.05 is amended by adding a new section to read:                                                    
05 Sec. 03.05.084. Confidentiality of certain information; exceptions. (a)                                                 
06 Notwithstanding AS 03.05.010(a)(2), a record that includes information about an                                         
07 animal that is maintained by the Department of Environmental Conservation to carry                                      
08 out the requirements of this chapter, including a record of the sale, movement, unique                                  
09 identification number, or owner of an animal, is confidential and not subject to                                        
10       disclosure under AS 40.25.100 - 40.25.295 (Alaska Public Records Act) if the record                               
11                 (1)  identifies a particular animal, breed of animal, business, or                                      
12       individual;                                                                                                       
13                 (2)  contains test results, or a record of test samples, for a particular                               
14       animal; or                                                                                                        

01 (3)  contains trade secrets or proprietary business or financial                                                        
02       information.                                                                                                      
03 (b) Notwithstanding (a) of this section, the Department of Environmental                                                
04 Conservation may disclose information from a record subject to this section to a state,                                 
05 federal, or local government or government agency, if the department determines that                                    
06 a threat to the health or safety of an animal or to the public exists and that disclosure                               
07       of the information is necessary to address the threat.                                                            
08 (c)  If the Department of Environmental Conservation discloses information                                              
09 under (b) of this section, the department shall, upon request, disclose the information                                 
10       to the public, except for information that identifies a particular person or animal.                              
11    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                            
12 read:                                                                                                                   
13 TRANSITION: REGULATIONS. The Department of Environmental Conservation                                                   
14 may adopt regulations necessary to implement this Act. The regulations take effect under                                
15 AS 44.62 (Administrative Procedure Act), but not before the effective date of the law                                   
16 implemented by the regulation.                                                                                          
17    * Sec. 3. Section 2 of this Act takes effect immediately under AS 01.10.070(c).
