AS 41.21.121 is amended to read: 05 Sec. 41.21.121. Chugach State Park established. The presently state-owned 06 land and water, and all that acquired in the future by the state, lying within the parcels 07 described in this section are designated as the Chugach State Park. The park is 08 established to protect and supply a satisfactory water supply for the use of the people, 09 to provide recreational opportunities for the people by providing areas for specified 10 uses and constructing the necessary facilities in those areas, to protect areas of unique 11 and exceptional scenic value, to provide areas for the public display of local wildlife, 12 and to protect the existing wilderness characteristics of the easterly interior area. 01 EAGLE RIVER, INC. (a) The Department of Natural Resources shall convey to the Eagle 02 River Lions Club of Eagle River, Inc., the surface estate of the real property used as the Lions 03 Club Park, in Eagle River, Alaska, located at Eagle River Road and Eagle River Loop Road, 04 within the Seward Meridian, Township 14 North, Range 2 West, Section 13, subject to the 05 requirement that the property be used as a public park; the commissioner of natural resources 06 shall retain a reversionary interest in the property requiring that the property be conveyed 07 back to the Department of Natural Resources if the property is not used as a public park. 08 (b) Before conveying property as described in this section, the Department of Natural 09 Resources shall grant necessary easements, including utility easements, to the Department of 10 Transportation and Public Facilities for Eagle River Road and Eagle River Loop Road. 11 (c) In consideration for the conveyance under (a) of this section, the Department of 12 Natural Resources may accept cash equivalent to, but not more than, $50,000. 13 (d) The Department of Natural Resources may take actions necessary to convey the 14 real property described in this section to the Eagle River Lions Club of Eagle River, Inc., 15 including platting, replatting, surveying, subdividing, and other actions. 16 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 17 read: 18 APPLICATION FOR APPROVAL OF CONVERSION REQUEST. The 19 commissioner of natural resources shall apply to the United States Department of the Interior, 20 National Park Service, in writing and in the manner provided by 36 C.F.R. 59.3(b), for 21 approval in 22 (1) converting certain real property acquired or developed with assistance 23 from 54 U.S.C. 200301 - 200310 (Land and Water Conservation Fund), subject to this Act; 24 and 25 (2) adding additional state land to Chugach State Park, established under sec. 26 1 of this Act. 27 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 28 read: 29 CONDITIONAL EFFECT; NOTIFICATION TO REVISOR OF STATUTES. (a) 30 Sections 1 and 2 of this Act take effect only if the United States Department of the Interior, 31 National Park Service, approves the conversion of real property effected by removing Lions
01 Club Park, as described in sec. 2 of this Act, from Chugach State Park and adding state land 02 under sec. 1 of this Act to Chugach State Park before January 1, 2030. 03 (b) If the conversion of the real property subject to this Act is approved by the United 04 States Department of the Interior, National Park Service, before January 1, 2030, the 05 commissioner of natural resources shall notify the revisor of statutes in writing not later than 06 20 days after receiving notice of the approval. 07 * Sec. 5. If, under sec. 4 of this Act, secs. 1 and 2 of this Act take effect, they take effect 08 January 1 of the calendar year following the date the commissioner of natural resources 09 notifies the revisor of statutes under sec. 4 of this Act. 10 * Sec. 6. Sections 3 and 4 of this Act take effect immediately under AS 01.10.070(c).
