00 CS FOR HOUSE BILL NO. 226(FIN) 01 "An Act relating to the compensation of certain employees of the executive branch, 02 judicial branch, and University of Alaska; relating to the compensation of certain 03 employees of the legislative branch; increasing the salaries of certain attorneys and 04 administrative law judges employed by the state; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. AS 39.27.011(k) is amended to read: 27 (k) Notwithstanding (a) - (j) and (l) of this section, the governor or a designee 28 of the governor may, on a case-by-case basis, authorize for a partially exempt 29 employee in the executive branch a higher pay than Step F. The authorization must be 30 based on a determination that the action serves a critical governmental interest of the 31 state, the employee possesses exceptional qualifications, recruitment difficulties exist,

01 or the action is necessary due to competitive salaries in the relevant labor market. A 02 determination made under this subsection must be in writing. 03 * Sec. 3. AS 39.27.011 is amended by adding new subsections to read: 04 (l) Effective July 1, 2023, the amounts set out in the salary schedule contained 05 in (a) of this section are increased by 15 percent for attorneys under 06 AS 39.25.120(c)(3), attorneys in the division of legal and research services within the 07 Legislative Affairs Agency, and the chief administrative law judge and administrative 08 law judges of the office of administrative hearings under AS 39.25.120(c)(20). 09 (m) The legislature shall increase the salary schedule in (a) of this section at 10 the same time and rate that the supervisory bargaining unit increases the salary 11 schedule for members of the bargaining unit. 12 * Sec. 4. AS 24.10.220; and AS 39.27.011(e) and 39.27.011(f) are repealed. 13 * Sec. 5. The uncodified law of the State of Alaska is amended by adding a new section to 14 read: 15 SALARY INCREASES FOR CERTAIN EXEMPT OFFICERS AND EMPLOYEES 16 OF THE EXECUTIVE BRANCH. The salary increases under AS 39.27.011(a), as repealed 17 and reenacted by sec. 1 of this Act, apply to public officers who are in the exempt service 18 under AS 39.25.110 and who are not members of a collective bargaining unit established 19 under AS 23.40.070 - 23.40.260 (Public Employment Relations Act) or otherwise covered by 20 AS 39.27.011(a). In this section, "public officers" includes permanent and temporary 21 employees in the executive branch, not including the governor, the lieutenant governor, or the 22 heads of principal departments of the executive branch. 23 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 24 read: 25 SALARY INCREASES FOR CERTAIN EMPLOYEES OF THE JUDICIAL 26 BRANCH. (a) The salary increases under AS 39.27.011(a), as repealed and reenacted by sec. 27 1 of this Act, apply to permanent and temporary employees and magistrates in the judicial 28 branch of the state government who are not members of a collective bargaining unit 29 established under AS 23.40.070 - 23.40.260 (Public Employment Relations Act) and who are 30 not otherwise covered by AS 39.27.011(a). 31 (b) Effective July 1, 2023, the salary increases applied by (a) of this section to

01 permanent and temporary employees and magistrates in the judicial branch of the state 02 government who are not members of a collective bargaining unit established under 03 AS 23.40.070 - 23.40.260 (Public Employment Relations Act) and who are not otherwise 04 covered by AS 39.27.011(a), as repealed and reenacted by sec. 1 of this Act, are increased by 05 10 percent for permanent and temporary employees and magistrates in the judicial branch of 06 the state government, other than justices and judges, who are not members of a collective 07 bargaining unit established under AS 23.40.070 - 23.40.260 (Public Employment Relations 08 Act) and who are not otherwise covered by AS 39.27.011(a). 09 * Sec. 7. The uncodified law of the State of Alaska is amended by adding a new section to 10 read: 11 SALARY INCREASES FOR CERTAIN EMPLOYEES OF THE UNIVERSITY OF 12 ALASKA. The employees of the University of Alaska who are not members of a collective 13 bargaining unit are entitled to receive salary increases in accordance with the compensation 14 policy of the Board of Regents of the University of Alaska. 15 * Sec. 8. The uncodified law of the State of Alaska is amended by adding a new section to 16 read: 17 TRANSITION: REGULATIONS. The commissioner of administration or the 18 personnel board may immediately adopt regulations necessary to implement the respective 19 changes made by this Act. The regulations are not subject to AS 44.62 (Administrative 20 Procedure Act). The regulations may take effect after the effective date of the law 21 implementing the regulation. 22 * Sec. 9. Section 8 of this Act takes effect immediately under AS 01.10.070(c). 23 * Sec. 10. Except as provided in sec. 9 of this Act, this Act takes effect July 1, 2022.
