01 "An Act relating to certain rail properties conveyed to the state under the Alaska                                      
02 Railroad Transfer Act."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 42.40.350 is amended by adding a new subsection to read:                                           
05 (e)  Notwithstanding the terms of any patent, interim conveyance, title, deed,                                          
06 or similar document that transfers rail properties of the Alaska Railroad to the state                                  
07 under 45 U.S.C. 1201 - 1214 (Alaska Railroad Transfer Act), the transfer of rail                                        
08 properties of the Alaska Railroad to the state under the Act only confirms, conveys,                                    
09 and vests in the state those interests reserved to the United States under former 43                                    
10       U.S.C. 975d that were exercised by the United States through construction and use                                 
11       before the repeal of 43 U.S.C. 975d by the Act. In this subsection, "rail properties of                           
12       the Alaska Railroad" has the meaning given in 45 U.S.C. 1202(10).
