00 HOUSE BILL NO. 181 01 "An Act making special appropriations relating to the American Rescue Plan Act; and 02 providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AMERICAN RESCUE PLAN ACT: CORONAVIRUS STATE AND LOCAL 05 FISCAL RECOVERY FUND. (a) The sum of $74,000,000 in federal receipts received from 06 the American Rescue Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus 07 State and Local Fiscal Recovery Funds, Section 9901, is appropriated to the Department of 08 Health and Social Services, public health, emergency programs for the purpose of health and 09 individual security needs for the fiscal years ending June 30, 2021, June 30, 2022, June 30, 10 2023, and June 30, 2024. 11 (b) The sum of $6,000,000 in federal receipts received from the American Rescue 12 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 13 Recovery Funds, Section 9901, is appropriated to the Department of Public Safety, domestic 14 violence and sexual assault, for the purpose of sexual assault and domestic violence grants for

01 the fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 02 (c) The sum of $150,000,000 in federal receipts received from the American Rescue 03 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 04 Recovery Funds, Section 9901, is appropriated to the Department of Commerce, Community, 05 and Economic Development for the purpose of tourism industry revitalization. 06 (d) The sum of $325,000,000 in federal receipts received from the American Rescue 07 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 08 Recovery Funds, Section 9901, is appropriated to the Department of Commerce, Community, 09 and Economic Development for the purpose of economic recovery and investment. 10 (e) The sum of $325,000,000 in federal receipts received from the American Rescue 11 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 12 Recovery Funds, Section 9901, is appropriated for the purpose of infrastructure investment. 13 (f) The sum of $120,000,000 in federal receipts received from the American Rescue 14 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 15 Recovery Funds, Section 9901, is appropriated to executive branch-wide appropriations for 16 the purpose of replacing unrestricted general fund appropriations for the provision of 17 government services under the guidance included in the American Rescue Plan Act for the 18 fiscal year ending June 30, 2021. 19 (g) The sum of $19,259,405 in federal receipts received from the American Rescue 20 Plan Act: Title IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal 21 Recovery Funds, Section 9901, is appropriated to executive branch-wide appropriations for 22 the provision of government services to the extent of the reduction in state restricted revenue 23 related to the COVID-19 pandemic for the fiscal years ending June 30, 2021, June 30, 2022, 24 June 30, 2023, and June 30, 2024. 25 (h) The sum of $112,259,292 in federal receipts received for capital projects directly 26 enabling work, education, and health monitoring from the American Rescue Plan Act: Title 27 IX, Committee on Finance, Subtitle M, Coronavirus State and Local Fiscal Recovery Funds, 28 Section 9901, is appropriated for capital projects under the application guidelines to be 29 established by the United States Department of Treasury. 30 (i) Unrestricted general fund appropriations made in ch. 8, SLA 2020, are reduced by 31 the amount listed in (f) of this section.

01 * Sec. 2. DEPARTMENT OF COMMERCE, COMMUNITY, AND ECONOMIC 02 DEVELOPMENT. The amount of federal receipts received for nonentitlement units of local 03 government and counties from the American Rescue Plan Act: Title IX, Committee on 04 Finance, Subtitle M, Coronavirus State and Local Fiscal Recovery Funds, Section 9901, 05 estimated to be $185,395,702, is appropriated to the Department of Commerce, Community, 06 and Economic Development, community and regional affairs, for grants to communities as 07 required by the American Rescue Plan Act for the fiscal years ending June 30, 2021, June 30, 08 2022, June 30, 2023, and June 30, 2024. 09 * Sec. 3. DEPARTMENT OF EDUCATION AND EARLY DEVELOPMENT. (a) The 10 amount of federal receipts received from the National Endowment for the Arts from the 11 American Rescue Plan Act: Title II, Committee on Health, Education, Labor, and Pensions, 12 Subtitle A, Education Matters, Section 2021, estimated to be $758,700, is appropriated to the 13 Department of Education and Early Development, Alaska State Council on the Arts for the 14 fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 15 (b) The amount of federal receipts received from the Institute of Museum and Library 16 Services from the American Rescue Plan Act: Title II, Committee on Health, Education, 17 Labor, and Pensions, Subtitle A, Education Matters, Section 2023, estimated to be 18 $2,159,300, is appropriated to the Department of Education and Early Development, Alaska 19 state libraries, archives, and museums, library operations for the fiscal years ending June 30, 20 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 21 * Sec. 4. DEPARTMENT OF HEALTH AND SOCIAL SERVICES. (a) The amount of 22 federal receipts received in Mental Health Block Grants from the American Rescue Plan Act: 23 Title II, Committee on Health, Education, Labor, and Pensions, Subtitle H, Mental Health and 24 Substance Use Disorder, Section 2701, estimated to be $3,038,000, is appropriated to the 25 Department of Health and Social Services, behavioral health, behavioral health prevention 26 and early intervention grants for the fiscal years ending June 30, 2021, June 30, 2022, 27 June 30, 2023, and June 30, 2024. 28 (b) The amount of federal receipts received for the purpose of substance abuse block 29 grants from the American Rescue Plan Act: Title II, Committee on Health, Education, Labor, 30 and Pensions, Subtitle H, Mental Health and Substance Use Disorder, Section 2702, estimated 31 to be $4,706,000, is appropriated to the Department of Health and Social Services, behavioral

01 health, behavioral health prevention and early intervention grants for the fiscal years ending 02 June 30, 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 03 (c) The amount of federal receipts received for the purpose of the Child Nutrition 04 Pandemic EBT Program from the American Rescue Plan Act: Title I, Committee on 05 Agriculture, Nutrition, and Forestry, Subtitle B, Nutrition, Section 1108, estimated to be 06 $768,400, is appropriated to the Department of Health and Social Services, public assistance, 07 public assistance administration for the fiscal years ending June 30, 2021, and June 30, 2022. 08 (d) The amount of federal receipts received for the purpose of pandemic emergency 09 assistance from the American Rescue Plan Act: Title IX, Committee on Finance, Subtitle C, 10 Emergency Assistance to Children and Families, Section 9201, estimated to be $3,363,500, is 11 appropriated to the Department of Health and Social Services, public assistance, Alaska 12 temporary assistance program for the fiscal years ending June 30, 2021, and June 30, 2022. 13 (e) The amount of federal receipts received for the purpose of child care stabilization 14 grants from the American Rescue Plan Act: Title I, Committee on Health, Education, Labor, 15 and Pensions, Subtitle C, Human Services and Community Supports, Section 2202, estimated 16 to be $45,453,000, is appropriated to the Department of Health and Social Services, public 17 assistance, child care benefits for the fiscal years ending June 30, 2021, and June 30, 2022. 18 (f) The amount of federal receipts received for the purpose of child care development 19 fund grants from the American Rescue Plan Act: Title I, Committee on Health, Education, 20 Labor, and Pensions, Subtitle C, Human Services and Community Supports, Section 2201, 21 estimated to be $28,410,000, is appropriated to the Department of Health and Social Services, 22 public assistance, child care benefits for the fiscal years ending June 30, 2021, and June 30, 23 2022. 24 (g) The amount of federal receipts received for the Low Income Home Energy 25 Assistance Program from the American Rescue Plan Act: Title I, Committee on Health, 26 Education, Labor, and Pensions, Subtitle K, Ratepayer Protection, Section 2911, estimated to 27 be $23,701,000, is appropriated to the Department of Health and Social Services, public 28 assistance, energy assistance program for the fiscal years ending June 30, 2021, June 30, 29 2022, June 30, 2023, and June 30, 2024. 30 (h) The amount of federal receipts received for the purpose of WIC benefit 31 improvements from the American Rescue Plan: Title I, Agriculture, Nutrition, and Forestry,

01 Subtitle B, Nutrition, Section 1105, estimated to be $1,160,000, is appropriated to the 02 Department of Health and Social Services, public assistance, public assistance administration 03 for the fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 04 (i) The amount of federal receipts received for the purpose of CDC funding for 05 COVID-19 testing from the American Rescue Plan Act: Title I, Committee on Health, 06 Education, Labor, and Pensions, Subtitle E, Testing, Section 2401, estimated to be 07 $22,033,800, is appropriated to the Department of Health and Social Services, public health, 08 emergency programs for the fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, 09 and June 30, 2024. 10 (j) The amount of federal receipts received for the purpose of CDC funding for 11 COVID-19 vaccinations from the American Rescue Plan Act: Title I, Committee on Health, 12 Education, Labor, and Pensions, Subtitle D, Public Health, Section 2301, estimated to be 13 $32,376,600, is appropriated to the Department of Health and Social Services, public health, 14 emergency programs for the fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, 15 and June 30, 2024. 16 (k) The amount of federal receipts received for the purpose of the Child Abuse 17 Prevention Act from the American Rescue Plan Act: Title I, Committee on Health, Education, 18 Labor, and Pensions, Subtitle C, Human Services and Community Supports, Section 2205, 19 estimated to be $291,000, is appropriated to the Department of Health and Social Services, 20 public health, emergency programs for the fiscal years ending June 30, 2021, June 30, 2022, 21 June 30, 2023, and June 30, 2024. 22 (l) The amount of federal receipts received for the purpose of supporting older 23 Americans and their families from the American Rescue Plan Act: Title I, Committee on 24 Health, Education, Labor, and Pensions, Subtitle L, Assistance for Older Americans, 25 Grandfamilies, and Kinship Families, Section 2921, estimated to be $7,045,000, is 26 appropriated to the Department of Health and Social Services, senior and disabilities services, 27 senior and disabilities services community-based grants for the fiscal years ending June 30, 28 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 29 * Sec. 5. DEPARTMENT OF LABOR AND WORKFORCE DEVELOPMENT. (a) The 30 amount of federal receipts received for the purpose of higher education emergency relief 31 funds to the Alaska Vocational Technical Center from the American Rescue Plan Act: Title II,

01 Committee on Health, Education, Labor, and Pensions, Subtitle A, Education Matters, Section 02 2003, estimated to be $441,000, is appropriated to the Department of Labor and Workforce 03 Development, Alaska Vocational Technical Center for the fiscal years ending June 30, 2021, 04 June 30, 2022, June 30, 2023, and June 30, 2024. 05 (b) The amount of federal receipts received for the purpose of unemployment 06 insurance mainframe system support from the American Rescue Plan Act: Title IX, 07 Committee on Finance, Subtitle A, Crisis Support for Unemployed Workers, Section 9032, 08 estimated to be $6,000,000, is appropriated to the Department of Labor and Workforce 09 Development. 10 * Sec. 6. DEPARTMENT OF MILITARY AND VETERANS' AFFAIRS. The amount of 11 federal receipts received for the purpose of emergency management grants from the 12 American Rescue Plan Act: Title IV, Committee on Homeland Security and Governmental 13 Affairs, Section 4014, estimated to be $882,300, is appropriated to the Department of Military 14 and Veterans' Affairs, homeland security and emergency management for the fiscal years 15 ending June 30, 2021, June 30, 2022, June 30, 2023, and June 30, 2024. 16 * Sec. 7. DEPARTMENT OF TRANSPORTATION AND PUBLIC FACILITIES. The 17 amount of federal receipts received for the purpose of federal transit administration grants 18 from the American Rescue Plan Act: Title III, Committee on Banking, Housing, and Urban 19 Affairs, Subtitle D, Public Transportation, Section 3401, estimated to be $6,625,503, is 20 appropriated to the Department of Transportation and Public Facilities, administration and 21 support, commissioner's office for the fiscal years ending June 30, 2021, June 30, 2022, 22 June 30, 2023, and June 30, 2024. 23 * Sec. 8. UNIVERSITY OF ALASKA. The amount of federal receipts received for the 24 purpose of the Higher Education Emergency Relief Fund from the American Rescue Plan 25 Act: Title II, Committee on Health, Education, Labor, and Pensions, Subtitle A, Education 26 Matters, Section 2003, estimated to be $30,800,000, is appropriated to University of Alaska, 27 statewide services for the fiscal years ending June 30, 2021, June 30, 2022, June 30, 2023, 28 and June 30, 2024. 29 * Sec. 9. COMPLIANCE; CONTINGENCIES. (a) All appropriations of federal receipts 30 from the American Rescue Plan Act are subject to current and future American Rescue Plan 31 Act guidelines issued by the United States Department of Treasury.

01 (b) If any appropriation or allocation specifically made in sec. 1 of this Act is 02 determined by the office of management and budget to be noncompliant with federal guidance 03 (1) the federal appropriation for the noncompliant purpose is reduced by the 04 amount determined to be noncompliant; 05 (2) the amount necessary for the noncompliant purpose is appropriated from 06 the general fund; and 07 (3) the appropriations made in sec. 1(f) and (i) of this Act are increased by an 08 amount equal to the amount determined to be noncompliant under (1) of this subsection. 09 (c) The office of management and budget will submit notification to the presiding 10 officers of each house of the legislature before implementing (b) of this section. 11 * Sec. 10. LAPSE. The appropriations made in secs. 1(c), 1(d), 1(e), 1(h), and 5(b) of this 12 Act are for capital projects and lapse under AS 37.25.020. 13 * Sec. 11. RETROACTIVITY. If this Act takes effect after June 30, 2021, this Act is 14 retroactive to June 30, 2021. 15 * Sec. 12. This Act takes effect immediately under AS 01.10.070(c).
