00 CS FOR HOUSE BILL NO. 177(STA) 01 "An Act relating to an increase of an appropriation due to additional federal or other 02 program receipts; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 37.07.080(h) is amended to read: 05 (h) If the legislature appropriates federal or other program receipts for a 06 program or project, an [THE] increase of the [AN] appropriation item for the 07 existing program or project based on additional federal or other program receipts not 08 specifically appropriated by the full legislature may be expended in accordance with 09 the following procedures: 10 (1) the governor shall submit a revised program or project to the 11 Legislative Budget and Audit Committee for review; 12 (2) [45 DAYS SHALL ELAPSE BEFORE COMMENCEMENT OF 13 EXPENDITURES UNDER THE REVISED PROGRAM] unless the Legislative 14 Budget and Audit Committee earlier recommends that the governor expend the
01 receipts under the revised program or project, the governor may not expend the 02 receipts under the revised program or project until the following periods have 03 elapsed: 04 (A) 45 days for expenditures not exceeding $20,000,000; 05 (B) 90 days for expenditures greater than $20,000,000 but 06 not exceeding $50,000,000; 07 (C) 180 days for expenditures greater than $50,000,000 but 08 not exceeding $100,000,000; 09 (D) 270 days for expenditures greater than $100,000,000 10 [STATE TAKE PART IN THE FEDERALLY OR OTHERWISE FUNDED 11 ACTIVITY]; 12 (3) should the Legislative Budget and Audit Committee recommend 13 within the applicable period described in (2) of this subsection [45-DAY PERIOD] 14 that the governor not expend the receipts under the revised program or project 15 [STATE NOT INITIATE THE ADDITIONAL ACTIVITY], the governor shall again 16 review the revised program or project, and, if the governor determines to authorize 17 the expenditure, the governor shall provide the Legislative Budget and Audit 18 Committee with a statement of the governor's reasons before commencement of 19 expenditures under the revised program or project. 20 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
