00 SENATE CS FOR HOUSE BILL NO. 22(RES) 01 "An Act relating to shared animal ownership; and relating to the sharing of raw milk 02 and raw milk products." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 17.20 is amended by adding a new section to read: 05 Sec. 17.20.015. Shared ownership of milk-producing animals; raw milk. 06 (a) An individual who has an ownership interest in a milk-producing animal may pay 07 or reimburse another individual owner of the animal the costs incurred to 08 (1) board, milk, and care for the animal; and 09 (2) share raw milk and raw milk products produced from the milk with 10 other owners of the animal. 11 (b) A part owner of a shared milk-producing animal may share raw milk or a 12 raw milk product produced from the milk of the animal only 13 (1) with another owner of the animal who has provided the part owner 14 with at least two means of contacting the other owner in the event of a foodborne

01 illness; 02 (2) if the raw milk or raw milk product is produced exclusively by the 03 owners of the animal; and 04 (3) if the raw milk or raw milk product is provided directly from one 05 owner to another owner. 06 (c) If the department suspects or determines that there is an outbreak of a 07 foodborne illness that can be traced to a facility where raw milk or raw milk products 08 are produced under this section, the department may exercise its authority under 09 AS 17.20.005(7) and (8) and AS 17.20.200 for that facility. 10 (d) The department may not restrict or impose a requirement on the sharing or 11 transfer of raw milk or a raw milk product between the owners of a milk-producing 12 animal that is in addition to the provisions of this section. 13 (e) In this section, 14 (1) "raw milk" means milk that is not pasteurized; 15 (2) "raw milk product" means raw milk or a product or byproduct of 16 raw milk. 17 * Sec. 2. AS 17.20.200(a) is amended to read: 18 (a) The commissioner of environmental conservation or an agent shall have 19 free access at reasonable hours to a factory, warehouse, or establishment in which 20 foods or cosmetics are manufactured, processed, packed, or held for introduction into 21 commerce, to enter a vehicle being used to transport or hold these foods or cosmetics 22 in commerce, [OR] to an aquatic farm, or to a facility, as provided under 23 AS 17.20.015(c), in order to 24 (1) inspect a factory, warehouse, establishment, vehicle, [OR] aquatic 25 farm, or facility to determine if the provisions of the commissioner's respective 26 portions of this chapter are being violated; and 27 (2) secure samples or specimens of a food, aquatic farm product, or 28 cosmetic.
