00 SENATE BILL NO. 233 01 "An Act relating to public employee and Alaska Railroad Corporation employee payroll 02 deductions for payment of union dues, fees, and political campaign contributions and 03 expenditures; prohibiting union security provisions in collective bargaining agreements 04 under the Public Employment Relations Act and the Alaska Railroad Corporation Act; 05 repealing unfair labor practice prohibitions under the Public Employment Relations Act 06 and the Alaska Railroad Corporation Act; and providing for an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 23.40.220 is amended to read: 09 Sec. 23.40.220. Employee [LABOR OR EMPLOYEE ORGANIZATION 10 DUES AND EMPLOYEE] benefits; [,] deduction and authorization. Upon written 11 authorization of a public employee within a bargaining unit, the public employer shall 12 deduct from the payroll of the public employee the monthly amount of [DUES, FEES, 13 AND OTHER] employee benefits as certified by the secretary of the exclusive

01 bargaining representative and shall deliver it to the chief fiscal officer of the exclusive 02 bargaining representative. The public employer may not deduct from the payroll of 03 the public employee for delivery to the exclusive bargaining representative an 04 amount for contribution or expenditure under AS 15.13 or an amount for 05 employee dues or fees. In this section, "contribution" and "expenditure" have 06 the meanings given in AS 15.13.400. 07 * Sec. 2. AS 23.40.225 is repealed and reenacted to read: 08 Sec. 23.40.225. Union security provisions prohibited. A collective 09 bargaining settlement reached or agreement entered into under this chapter may not 10 contain a union security provision, including a union shop or agency shop provision or 11 agreement. 12 * Sec. 3. AS 42.40.870 is amended to read: 13 Sec. 42.40.870. Employee [ORGANIZATION DUES AND EMPLOYEE] 14 benefits; deduction and authorization. Upon written authorization of an employee 15 within a bargaining unit, the corporation shall deduct from the payroll of the employee 16 the monthly amount of [DUES, FEES, AND OTHER] employee benefits as certified 17 by the secretary of the exclusive bargaining representative and shall deliver it to the 18 chief fiscal officer of the exclusive bargaining representative. The corporation may 19 not deduct from the payroll of the public employee for delivery to the exclusive 20 bargaining representative an amount for contribution or expenditure under 21 AS 15.13 or an amount for employee dues or fees. In this section, "contribution" 22 and "expenditure" have the meanings given in AS 15.13.400. 23 * Sec. 4. AS 42.40.880. is repealed and reenacted to read: 24 Sec. 42.40.880. Union security provisions prohibited. A collective 25 bargaining settlement reached or agreement entered into under this chapter may not 26 contain a union security provision, including a union shop or agency shop provision or 27 agreement. 28 * Sec. 5. AS 23.40.110(b) and AS 42.40.760(b) are repealed. 29 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 30 read: 31 APPLICABILITY. This Act applies to collective bargaining agreements that take

01 effect on or after the effective date of this Act. 02 * Sec. 7. This Act takes effect immediately under AS 01.10.070(c).
