00 SENATE BILL NO. 69 01 "An Act establishing an exception from permit and fee requirements for certain 02 charitable gaming activities; relating to fees for applicants for a charitable gaming 03 permit; amending the definition of 'permittee'; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 05.15 is amended by adding a new section to read: 06 Sec. 05.15.055. Exception; annual permit and fees; small charitable 07 gaming. (a) Notwithstanding any other provision of this chapter, a municipality or 08 qualified organization may conduct any activity permitted under this chapter without a 09 permit and without paying a fee, so long as the annual gross receipts of the 10 municipality or qualified organization from those activities are less than $20,000. 11 (b) Notwithstanding any other provision of this chapter, a municipality or 12 qualified organization that limits its activities under (a) of this section does not need to 13 file any report or apply for registration under this chapter. 14 (c) A municipality or qualified organization that limits its activities under (a)

01 of this section must file an annual certification, under the penalty of perjury, that 02 certifies compliance with (a) of this section. 03 * Sec. 2. AS 05.15.115(a) is amended to read: 04 (a) A permittee [A MUNICIPALITY OR QUALIFIED ORGANIZATION 05 HOLDING A PERMIT TO CONDUCT AN ACTIVITY UNDER THIS CHAPTER] 06 may enter into a contract with an operator licensed under this chapter to conduct on 07 behalf of the municipality or qualified organization those activities permitted under the 08 authority of the permit. 09 * Sec. 3. AS 05.15.185 is amended to read: 10 Sec. 05.15.185. Distribution of pull-tab games. Each series of pull-tabs 11 distributed in the state must be sealed and have a serial number label issued by the 12 National Association of Fundraising Ticket Manufacturers or other serial number label 13 approved by the department and may be distributed only to 14 (1) A permittee [A MUNICIPALITY OR A QUALIFIED 15 ORGANIZATION THAT HAS OBTAINED A PERMIT ISSUED UNDER THIS 16 CHAPTER]; 17 (2) an operator on behalf of an authorizing permittee; or 18 (3) a distributor licensed under this chapter. 19 * Sec. 4. AS.05.15.690 is amended to read: 20 (35) "permittee" means a municipality or a qualified organization that 21 holds a valid permit under AS 05.15.100, or a municipality or qualified 22 organization that may conduct an activity authorized under this chapter without 23 a permit and without paying a fee under AS 05.15.055(a); 24 * Sec. 5. AS 05.15.020(c)(1) and 05.15.020(c)(2) are repealed. 25 * Sec. 6. The uncodified law of the State of Alaska is amended by adding a new section to 26 read: 27 TRANSITION: REGULATIONS. The Department of Revenue may adopt regulations 28 necessary to implement the changes made by this Act. The regulations take effect under 29 AS 44.62 (Administrative Procedure Act), but not before the effective date of the law 30 implemented by the regulation. 31 * Sec. 7. Section 6 of this Act takes effect immediately under AS 01.10.070(c).

01 * Sec. 8. Except as provided in sec. 7 of this Act, this Act takes effect January 1, 2020.
