01 "An Act relating to voting by electronic transmission in a state election."                                             
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 15.20.066(a) is amended to read:                                                                   
04 (a)  The director shall adopt regulations applicable to the delivery of absentee                                        
05 ballots by electronic transmission in a state election and to the use of electronic                                     
06 transmission absentee voting in a state election by qualified voters. The regulations                                   
07       [MUST]                                                                                                            
08                 (1)  must require the voter to comply with the same time deadlines as                               
09       for voting in person on or before the closing hour of the polls;                                                  
10                 (2)  must ensure the accuracy and, to the greatest degree possible, the                             
11       integrity and secrecy of the ballot process;                                                                  
12                 (3)  must allow an absentee ballot to be sent to the voter by                                       
13       facsimile or other electronic transmission approved by the director;                                          
14                 (4)  may not allow a voter to return an absentee ballot by facsimile,                               
15       unless the voter is an absent uniformed services voter.                                                       

01    * Sec. 2. AS 15.80.010(1) is amended to read:                                                                      
02                 (1)  "absent uniformed services voter" has the meaning given in 52                                  
03       U.S.C. 20310 [42 U.S.C. 1973ff-6];                                                                            
04    * Sec. 3. AS 15.20.066(b) is repealed.
