00 CS FOR HOUSE BILL NO. 48(FIN) am 01 "An Act removing from the exempt service of the state persons who are employed in a 02 professional capacity to make a temporary or special inquiry, study, or examination as 03 authorized by the governor and including those persons in the partially exempt service 04 of the state; repealing the authority of the governor or a designee of the governor to 05 authorize higher pay than is otherwise allowable for certain partially exempt employees 06 in the executive branch; requiring the commissioner of administration to submit a 07 report to the legislature; and providing for an effective date." 08 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. AS 39.25.120(c) is amended by adding a new paragraph to read: 10 (22) persons employed in a professional capacity to make a temporary 11 or special inquiry, study, or examination as authorized by the governor. 12 * Sec. 2. AS 39.25.110(9) and AS 39.27.011(k) are repealed. 13 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to

01 read: 02 APPLICABILITY: LIMITED EFFECT OF REPEAL. The repeal of AS 39.27.011(k) 03 by sec. 2 of this Act applies to employment contracts entered into on or after the effective date 04 of sec. 2 of this Act. 05 * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 06 read: 07 TRANSITION. Not later than 60 days after the effective date of this Act, the 08 commissioner of administration shall prepare and submit to the legislature a report that 09 includes a list of all positions in the exempt service of the state under AS 39.25.110 and the 10 partially exempt service of the state under AS 39.25.120 and the salary and proposed salary 11 schedule for each of those positions. The commissioner of administration shall deliver the 12 report to the senate secretary and the chief clerk of the house of representatives and notify the 13 legislature that the report is available. 14 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
