00 SENATE BILL NO. 126 01 "An Act providing for an exception to the regulation of the practice of medicine for a 02 physician who provides medical services to an athletic team from another state." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.64.370 is amended to read: 05 Sec. 08.64.370. Exceptions to application of chapter. This chapter does not 06 apply to 07 (1) officers in the regular medical service of the armed services of the 08 United States or the United States Public Health Service while in the discharge of their 09 official duties; 10 (2) a physician or osteopath, who is not a resident of this state, who is 11 asked by a physician or osteopath licensed in this state to help in the diagnosis or 12 treatment of a case; 13 (3) the practice of the religious tenets of a church; 14 (4) a physician in the regular medical service of the United States

01 Public Health Service or the armed services of the United States volunteering services 02 without pay or other remuneration to a hospital, clinic, medical office, or other 03 medical facility in the state; 04 (5) a person who is certified as a direct-entry midwife by the 05 department under AS 08.65 while engaged in the practice of midwifery whether or not 06 the person accepts compensation for those services; 07 (6) a physician licensed in another state who, under a written 08 agreement with an athletic team located in the state in which the physician is 09 licensed, provides medical services to members of the athletic team while the 10 athletic team is traveling to or from or participating in a sporting event in this 11 state. 12 * Sec. 2. AS 14.30.142(d) is amended to read: 13 (d) A student who has been removed from participation in a practice or game 14 for suspicion of concussion may not return to participation in practice or game play 15 until the student has been evaluated and cleared for participation in writing by an 16 athletic trainer or other qualified person who has received training, as verified in 17 writing or electronically by the qualified person, in the evaluation and management of 18 concussions. In this subsection, "qualified person" means either a 19 (1) health care provider who is licensed in the state or exempt from 20 licensure under state law; or 21 (2) person who is acting at the direction and under the supervision of a 22 physician who is licensed in the state or exempt from licensure under 23 AS 08.64.370(1), (2), [OR] (4), or (6).
