00 CS FOR HOUSE BILL NO. 409(STA) 01 "An Act relating to identification cards; relating to vehicle registration fee rates; 02 relating to changes of address; relating to driver's license fees; and relating to financial 03 responsibility for motor vehicles." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 18.65.310(g) is amended to read: 06 (g) If the person applying for the identification card provided for in (a) of this 07 section is 65 [60] years of age or older, charge may not be made for issuance of the 08 card. 09 * Sec. 2. AS 28.05.071 is amended by adding a new subsection to read: 10 (c) A person is not required to notify the appropriate department of a change in 11 mailing address under (a) of this section if the person authorizes the appropriate 12 department to change the person's mailing address automatically to match the current 13 mailing address maintained by the United States Postal Service. A person shall notify 14 the appropriate department under (a) of this section of a change in the person's

01 residence address if the person's residence address is different from the person's 02 mailing address. 03 * Sec. 3. AS 28.20.050(a) is amended to read: 09 (a) The provisions of this chapter requiring deposit of security and suspension 10 for failure to deposit security apply to the driver and owner of a vehicle subject to 11 registration under the laws of this state that is involved in any manner in an accident in 12 this state resulting in bodily injury to or death of a person or damage to the property of 13 any one person exceeding $2,000 [$501]. 14 * Sec. 7. AS 28.20.050(e) is amended to read: 15 (e) A peace officer investigating an accident that results in bodily injury to or 16 the death of a person or damage to the property of a person exceeding $2000 [$501] 17 shall inform persons involved in the accident in writing of the requirements of this 18 chapter as they apply to suspension of an operator's license or driving privileges. 19 * Sec. 8. AS 28.20.100(c) is amended to read: 20 (c) If the department evaluates the injuries or damage to a minor in an amount 21 not more than $2000 [$501], the department may accept, for the purposes of this 22 chapter only, evidence of a release from liability executed by a parent or legal 23 guardian on behalf of the minor without court approval. 24 * Sec. 9. AS 28.20.230(a) is amended to read: 25 (a) The provisions of this chapter requiring the deposit of proof of financial 26 responsibility for the future apply to persons who are convicted of or forfeit bail for 27 certain offenses under motor vehicle laws or who, by ownership or operation of a 28 vehicle of a type subject to registration under AS 28.10, are involved in an accident in 29 this state that results in bodily injury to or death of a person or damage to the property 30 of any one person exceeding $2000 [$501]. 31 * Sec. 10. AS 28.20.260(a) is amended to read:

01 (a) Upon receipt by the department of the report of an accident resulting in 02 bodily injury to or death of a person, or damage to the property of any one person 03 exceeding $2000 [$501], the department shall suspend the license of the driver of a 04 motor vehicle involved in the accident unless the driver or owner 05 (1) has previously furnished or immediately furnishes security required 06 by this chapter, or is excepted from furnishing security under AS 28.20.060; and 07 (2) maintains proof of financial responsibility for three years following 08 the accident. 09 * Sec. 11. AS 28.20.330 is amended to read: 10 Sec. 28.20.330. Suspension to continue until judgments paid and proof 11 given. (a) If there is an unsatisfied judgment against a person requiring suspension 12 under AS 28.20.270, the person's license or nonresident's operating privilege shall 13 remain suspended and may [SHALL] not be renewed, nor shall a license or 14 registration be issued in the name of the person, including a person not previously 15 licensed, until the judgment is stayed or satisfied. In addition, a person who did not 16 have insurance at the time of the accident giving rise to the judgment shall 17 provide [AND UNTIL THE PERSON GIVES] proof of financial responsibility, 18 subject to the exceptions in AS 28.20.310, 28.20.320, and 28.20.370, before the 19 person's license or nonresident's operating privilege may be issued or renewed. 20 (b) The proof required by (a) of this section shall be maintained for three 21 years from the date the judgment is stayed or satisfied [DURING THE PERIOD 22 THE PERSON HAS A LICENSE OR NONRESIDENT'S OPERATING 23 PRIVILEGE]. 24 * Sec. 12. AS 28.20.370(c) is amended to read: 25 (c) If the judgment debtor fails to pay an installment specified by the court 26 order, upon notice of default, the department shall immediately suspend the license or 27 nonresident's operating privilege of the judgment debtor until the judgment is satisfied 28 as provided in this chapter or until a new agreement to pay an installment is 29 received with proof of future financial responsibility. 30 * Sec. 13. AS 28.22.021 is amended to read: 31 Sec. 28.22.021. Requirement of proof of motor vehicle liability insurance.

01 The owner or operator of a motor vehicle required to have motor vehicle liability 02 insurance that complies with this chapter or a certificate of self-insurance that 03 complies with AS 28.20.400, shall show proof of this insurance when that person is 04 involved in an accident that results in bodily injury to or death of a person, or damage 05 to the property of a person exceeding $2000 [$501]. 06 * Sec. 14. AS 28.35.135 is amended by adding a new subsection to read: 07 (c) A person is not required to notify the department of a change in mailing 08 address under (b) of this section if the person has authorized the department to change 09 the person's mailing address automatically under AS 28.05.071.
