01 "An Act relating to payments to providers and covered persons and recovery of                                           
02 payments by health care insurers."                                                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 21.54.020(d) is amended to read:                                                                   
05 (d)  This section does not prohibit a health care insurer from recovering an                                            
06 amount mistakenly paid to a provider or a covered person. A health care insurer may                                 
07 not seek recovery of an amount mistakenly paid more than 18 months after the                                        
08       date the claim was paid unless the                                                                            
09                 (1)  claim was submitted fraudulently;                                                              
10                 (2)  payment was made for a duplicate claim;                                                        
11                 (3)  health care services identified in the claim were not delivered                                
12       by the health care provider;                                                                                  
13                 (4)  payment or claim is subject to adjustment by another health                                    
14       care insurer; or                                                                                              

01                 (5)  payment or claim is the subject of legal action.                                               
02    * Sec. 2. AS 21.54.050(d) is amended to read:

05 seek recovery of an amount mistakenly paid more than 18 months after the date                                       
06       the claim was paid unless the

08                 (2)  payment was made for a duplicate claim;                                                        
09                 (3)  health care services identified in the claim were not delivered                                
10       by the health care provider;                                                                                  
11                 (4)  payment or claim is subject to adjustment by another health                                    
12       care insurer; or                                                                                              
13                 (5)  payment or claim is the subject of legal action.
