00 HOUSE BILL NO. 300 01 "An Act prohibiting the expenditure of state or municipal assets to enforce federal 02 marijuana laws; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 44.99.040(a) is amended to read: 05 (a) A state or municipal agency may not use or authorize the use of an asset to 06 (1) implement or aid in the implementation of a requirement of 07 [(1)] an order of the President of the United States, a federal 08 regulation, or a law enacted by the United States Congress that is applied to 09 (A) infringe on a person's right, under the Second Amendment 10 to the Constitution of the United States, to keep and bear arms; 11 (B) deny a person a right to due process, or a protection of due 12 process, that would otherwise be available to the person under the Constitution 13 of the State of Alaska or the Constitution of the United States; or 14 (2) enforce or aid in the enforcement of federal criminal laws
01 involving marijuana that are inconsistent with state law under AS 17.38 and the 02 right to privacy in art. I, sec. 22, Constitution of the State of Alaska; in this 03 paragraph, "marijuana" has the meaning given in AS 11.71.900 [REPEALED]. 04 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
