00 HOUSE BILL NO. 239 01 "An Act relating to a limitation on the powers of a port authority to engage in a 02 liquefied natural gas project related to the transportation of natural gas produced on 03 the North Slope of Alaska; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 29.35.620 is amended by adding new subsections to read: 06 (b) Notwithstanding the powers granted under (a) of this section, an authority 07 that has not issued bonds or bond anticipation notes for the development, financing, 08 construction, or operation of a liquefied natural gas project before the effective date of 09 this Act may not engage in the development, financing, construction, or operation of a 10 liquefied natural gas project that produces or transports to tidewater or a market in this 11 state natural gas that is produced from a state oil and gas lease or gas only lease that 12 includes land north of 68 degrees North latitude. In this subsection, 13 (1) "gas treatment plant" has the meaning given in AS 31.25.390; 14 (2) "liquefied natural gas plant" has the meaning given in
01 AS 31.25.390; 02 (3) "liquefied natural gas project" means a project that includes a 03 natural gas pipeline, gas treatment plant, liquefied natural gas plant, or marine 04 terminal; 05 (4) "marine terminal" has the meaning given in AS 31.25.390; 06 (5) "natural gas pipeline" has the meaning given in AS 31.25.390. 07 (c) Subsection (b) of this section does not prohibit an authority from 08 developing, financing, constructing, or operating a natural gas distribution system 09 within a municipality that has created or joined the authority. 10 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
