00 HOUSE BILL NO. 204 01 "An Act relating to overtaking and passing certain stationary vehicles." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 28.35.185(a) is amended to read: 04 (a) The driver of a vehicle that approaches a stationary emergency vehicle, fire 05 vehicle, law enforcement vehicle, tow truck in the act of picking up a vehicle, vehicle 06 operated by the Department of Transportation and Public Facilities in the act of 07 performing maintenance or road service work, or animal control vehicle being used 08 to perform official duties, when the stationary vehicle is displaying flashing 09 emergency lights on a highway or roadway 10 (1) with two or more lanes traveling in the same direction, unless 11 otherwise directed by law enforcement or emergency personnel, shall 12 (A) if possible in the existing safety and traffic conditions, 13 vacate the lane closest to the emergency vehicle, fire vehicle, law enforcement 14 vehicle, tow truck in the act of picking up a vehicle, vehicle operated by the 15 Department of Transportation and Public Facilities in the act of

01 performing maintenance or road service work, or animal control vehicle 02 being used to perform official duties; or 03 (B) if a lane change under (A) of this paragraph would be 04 impossible, prohibited by law, or unsafe, slow to a reasonable and prudent 05 speed considering the traffic, roadway, and weather conditions; 06 (2) with fewer than two lanes traveling in the same direction, unless 07 otherwise directed by law enforcement or emergency personnel, shall slow to a 08 reasonable and prudent speed considering the traffic, roadway, and weather 09 conditions.
