00 HOUSE BILL NO. 194 01 "An Act relating to members and veterans of the uniformed services, including the 02 Commissioned Corps of the United States Public Health Service and the National 03 Oceanic and Atmospheric Administration Commissioned Officer Corps." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 18.50.320 is amended to read: 06 Sec. 18.50.320. Copies of data from vital records. Except as otherwise 07 provided and in accordance with the regulations adopted under AS 18.50.310, 08 (1) the bureau and the custodian of permanent local records shall, upon 09 request, issue a certified copy of a certificate or record in their custody, or a part of it; 10 each copy issued must show the date of registration or recording, and copies issued 11 from records marked "delayed," "amended," or "court order" shall be similarly marked 12 and must show the effective date; 13 (2) a certified copy of a certificate or a part of it issued in accordance 14 with (1) of this section is considered the original for all purposes and is prima facie

01 evidence of the facts stated; however, the evidentiary value of a certificate or record 02 filed more than one year after the event, or a record that has been amended, or a 03 presumptive death certificate, shall be determined by the judicial or administrative 04 body or official before whom the certificate is offered as evidence; 05 (3) the National Office of Vital Statistics may be furnished the copies 06 or data it requires for national statistics if the bureau is reimbursed for the cost of 07 furnishing the data; the National Office of Vital Statistics may not use the data for 08 purposes other than statistical purposes unless authorized by the state registrar; 09 (4) federal, state, local, and other public or private agencies, upon 10 request, may be furnished copies or data for statistical purposes on the terms or 11 conditions prescribed by the bureau; 12 (5) a person or agency may not prepare or issue a certificate or part of 13 a certificate that purports to be an original, certified copy, or copy of a certificate of 14 birth, death, fetal death, or marriage, except as authorized in this chapter or the 15 regulations adopted under it; 16 (6) upon request, the bureau shall furnish a copy of a certificate or 17 record registered by the bureau to the child support services agency created in 18 AS 25.27.010, or the child support enforcement agency of another state, for child 19 support purposes authorized under law; such a certificate or record that is prepared or 20 maintained in an electronic data base may be supplied by providing the requesting 21 agency with a copy of the electronic certificate or record and a statement certifying its 22 contents; 23 (7) the bureau shall issue up to four certified copies of the death 24 certificate of a veteran without charge; under this paragraph, certified copies of a 25 veteran's death certificate are available without charge only to a qualified person; in 26 this paragraph, 27 (A) "qualified person" means an individual who is 28 (i) a personal representative of the veteran's estate; 29 (ii) a trustee of a revocable trust of which the veteran 30 was the settlor; or 31 (iii) a person who needs a certified copy of the veteran's

01 death certificate for the purpose of satisfying an eligibility requirement 02 for a benefit related to the death of the veteran; 03 (B) "veteran" means an individual who was 04 (i) on active duty at the time of the veteran's death or 05 had received an honorable or general discharge from a branch of the 06 armed services of the United States, the National Guard, a reserve unit 07 of the United States armed services, the Commissioned Corps of the 08 United States Public Health Service, the National Oceanic and 09 Atmospheric Administration Commissioned Officer Corps, the 10 Alaska Scouts, the Alaska Territorial Guard, or the Alaska Naval 11 Militia; and 12 (ii) a resident of the state at the time of the individual's 13 death. 14 * Sec. 2. AS 18.55.470(4) is amended to read: 15 (4) "veteran" means a person 16 (A) honorably separated from the uniformed services 17 [MILITARY SERVICE] of the United States who has at any time resided 18 continuously for at least one year in the state, and who served in the 19 uniformed services [ARMED FORCES] of the United States for at least 90 20 days or whose service was for less than 90 days because of injury or disability 21 incurred in the line of duty, 22 (i) between September 16, 1940, and July 25, 1947; 23 (ii) between June 25, 1950, and January 31, 1955; 24 (iii) between August 4, 1964, and November 7, 1975; 25 (iv) between August 2, 1990, and January 2, 1992; 26 (v) beginning September 11, 2001, and ending on the 27 day prescribed by Presidential proclamation or by law as the last date 28 of Operation Iraqi Freedom; or 29 (vi) during any of the time periods listed in 5 U.S.C. 30 2108(1); 31 (B) who served in the Alaska Territorial Guard for at least 90

01 days or whose service was for less than 90 days because of injury or disability 02 incurred in the line of duty, and who has at any time resided continuously for 03 at least one year in the state; 04 (C) who is the spouse or widow or widower of a person 05 described under (A) or (B) of this paragraph. 06 * Sec. 3. AS 18.55.470 is amended by adding a new paragraph to read: 07 (5) "uniformed services" means the armed forces of the United States, 08 the Commissioned Corps of the United States Public Health Service, and the National 09 Oceanic and Atmospheric Administration Commissioned Officer Corps. 10 * Sec. 4. AS 18.56.101 is amended to read: 11 Sec. 18.56.101. Eligibility for veterans' interest rates. The following persons 12 are eligible veterans for the purposes of AS 18.56.098(f) and (g): 13 (1) a person who served in the armed forces of the United States for 90 14 days or more, or whose service was for less than 90 days because of injury or 15 disability incurred in the line of duty, after April 6, 1917, whose discharge was under 16 honorable conditions; 17 (2) the widow or widower of a member of the uniformed services 18 [ARMED FORCES] or an eligible veteran if the member or veteran served in the 19 uniformed services [ARMED FORCES] for at least 90 days after April 6, 1917, and 20 the veteran's discharge was under honorable conditions; in this paragraph, 21 "uniformed services" means the armed forces of the United States, the 22 Commissioned Corps of the United States Public Health Service, and the 23 National Oceanic and Atmospheric Administration Commissioned Officer 24 Corps; 25 (3) a person who has served for not less than five years in the Alaska 26 Army National Guard, or the Alaska Air National Guard, or a reserve unit of the 27 United States armed forces if the reserve unit required, as a minimum, one weekend 28 each month of duty and 15 consecutive days of active duty training each year and 29 (A) whose discharge was under honorable conditions; or 30 (B) who is currently in an active status in the guard or a reserve 31 unit;

01 (4) a person who has served as a regular or reserve commissioned 02 officer of the Commissioned Corps of the United States [REGULAR OR 03 RESERVE CORPS OF THE] Public Health Service or the National Oceanic and 04 Atmospheric Administration Commissioned Officer Corps and whose discharge 05 was under honorable conditions; 06 (5) a person who served in the Alaska Territorial Guard for 90 days or 07 more or whose service was for less than 90 days because of injury or disability 08 incurred in the line of duty; 09 (6) the widow or widower of a person who served at least 90 days in 10 the Alaska Territorial Guard. 11 * Sec. 5. AS 18.65.310(l) is amended to read: 12 (l) At the request of the person, the department shall provide a veteran 13 designation and United States flag replica on an identification card identifying the 14 person as a retired veteran or a veteran of the armed forces of the United States, the 15 Commissioned Corps of the United States Public Health Service, or the National 16 Oceanic and Atmospheric Administration Commissioned Officer Corps who was 17 discharged under honorable conditions. The department may not charge a fee solely 18 for the designation. To receive a veteran designation, the person shall provide proof of 19 veteran status that shows the person is retired or discharged under honorable 20 conditions. With the approval of the person, the department shall make available to the 21 Department of Military and Veterans' Affairs the name and address of a person 22 receiving a veteran designation under this subsection. Notwithstanding (a) of this 23 section, the department may charge a fee of $5 for replacement of a valid 24 identification card with a new identification card with a veteran designation. 25 * Sec. 6. AS 26.10.070(a) is amended to read: 26 (a) A veteran of the armed forces, the Commissioned Corps of the United 27 States Public Health Service, or the National Oceanic and Atmospheric 28 Administration Commissioned Officer Corps may record without fee the veteran's 29 [ARMED FORCES] report of separation at a recorder's office of the Department of 30 Natural Resources. 31 * Sec. 7. AS 26.10.080(d)(2) is amended to read:

01 (2) "veteran" means 02 (A) a person who served in a branch of the armed services of 03 the United States, in the Commissioned Corps of the United States Public 04 Health Service, or in the National Oceanic and Atmospheric 05 Administration Commissioned Officer Corps 06 (i) who at the time of entry into the service was a 07 resident of the territory or state, who had been a resident for not less 08 than one year immediately before entry into the service, and who 09 returned to the territory or state within one year after discharge as a 10 resident with the intention of remaining in the territory or state; or 11 (ii) who was a resident of the state for not less than one 12 year immediately preceding the time of death; or 13 (B) a person who served in the Alaska Territorial Guard, the 14 Alaska Army National Guard, the Alaska Air National Guard, or the Alaska 15 Naval Militia, or who served in a reserve unit of the United States armed forces 16 in Alaska if the reserve unit required a minimum of one weekend of duty each 17 month and 15 consecutive days of active duty training each year for not less 18 than three years. 19 * Sec. 8. AS 26.15.130(a) is amended to read: 20 (a) Qualifications for loans under this chapter are as follows: 21 (1) persons who served in the uniformed services [ARMED 22 FORCES] of the United States for 90 days or more, or whose service was for less than 23 90 days because of injury or disability incurred in the line of duty, between April 6, 24 1917, and November 11, 1918, between September 16, 1940, and November 7, 1975, 25 between August 2, 1990, and January 2, 1992, or beginning September 11, 2001, and 26 ending on the day prescribed by Presidential proclamation or by law as the last date of 27 Operation Iraqi Freedom, or who served in a combat zone during any period of armed 28 conflict, or during any time period listed in 5 U.S.C. 2108(1), who were separated 29 from the uniformed services [ARMED FORCES] with a discharge other than 30 dishonorable, and 31 (A) who, at the time of induction into the service, were

01 residents of the territory or state, who had been residents for not less than one 02 year immediately before their induction, and who returned to the territory or 03 state after discharge as residents with the intention of remaining in the territory 04 or state; or 05 (B) who, not being bona fide residents of the territory or state 06 before their entry into the service, have been residents of the territory or state 07 for one or more years; 08 (2) persons who were dependent on a member of the uniformed 09 services [ARMED FORCES] or a veteran of World War II at the time of the member's 10 or veteran's death, if 11 (A) the member or veteran was a resident of the territory or 12 state for one year before induction into the service; [AND] 13 (B) the member or veteran served in the uniformed services 14 [ARMED FORCES] for at least 90 days between September 16, 1940, and 15 July 25, 1947, but benefits for loans do not accrue to dependents of an enlistee 16 or re-enlistee for time served after November 1, 1945, regardless of whether 17 the enlistment or reenlistment was before or after November 1, 1945; [AND] 18 (C) the member or veteran died before the official date of the 19 termination of that war; and 20 (D) the member's or veteran's discharge was not dishonorable; 21 (3) persons who have served in the Alaska Army National Guard or the 22 Alaska Air National Guard or the Alaska Naval Militia for not less than six years and 23 who have not received a discharge other than honorable. 24 * Sec. 9. AS 26.15.130(b) is amended to read: 25 (b) Dependents under (a) of this section must be unmarried and the deceased 26 member of the uniformed services [ARMED FORCES] or deceased veteran must 27 have been their chief means of support and they must be either a widow, widower, 28 minor son, minor daughter, or mother, father, sister or brother incapable of self- 29 support. Dependents must be residents of the territory or state at the time of making 30 application and intend to reside in the territory or state permanently. The rights of 31 minor children may be exercised only if they have no surviving parent and have an

01 appointed guardian who may apply on their behalf to secure a loan for their care, 02 support, education or other purposes mentioned in AS 26.15.040 or to receive the 03 bonus for those purposes. 04 * Sec. 10. AS 26.15.160 is amended to read: 05 Sec. 26.15.160. Extension of chapter to members of the Alaska Territorial 06 Guard and to veterans of the uniformed services [ARMED FORCES] of the 07 United States. The provisions of this chapter, except those provisions relating to the 08 payment of bonuses, are extended to persons who served in the Alaska Territorial 09 Guard and to veterans of the uniformed services [ARMED FORCES] of the United 10 States, who served other than dishonorably on active duty between June 25, 1950, and 11 January 31, 1955, between August 4, 1964, and November 7, 1975, between August 2, 12 1990, and January 2, 1992, beginning September 11, 2001, and ending on the day 13 prescribed by Presidential proclamation or by law as the last date of Operation Iraqi 14 Freedom, or during any time period listed in 5 U.S.C. 2108(1) and to dependents of 15 those persons, subject to the following provisions and eligibility qualifications: 16 (1) persons are eligible 17 (A) who served in the Alaska Territorial Guard, who were 18 discharged other than dishonorably from the uniformed services [ARMED 19 FORCES] of the United States, or who are released to a reserve component; 20 [AND] 21 (B) who, at the time of entry into the service, were bona fide 22 residents of the territory or State of Alaska and had been residents of the 23 territory or state for not less than one year before their entry into the service; 24 and who have returned to the territory or state within a reasonable length of 25 time after the end of their service in the Alaska Territorial Guard or their 26 discharge or separation as residents with the intention of remaining in the 27 territory or state; or who, not being bona fide residents of the territory before 28 their entry into the service, have lived in the territory or state for at least five 29 years following their release from active military service; and 30 (C) who served in the uniformed services [ARMED 31 FORCES] of the United States for 90 days or more, or whose service was for a

01 lesser period because of injury or disability incurred in line of duty, between 02 June 25, 1950, and January 31, 1955, between August 4, 1964, and July 1, 03 1977, between August 2, 1990, and January 2, 1992, beginning September 11, 04 2001, and ending on the day prescribed by Presidential proclamation or by law 05 as the last date of Operation Iraqi Freedom, or during any time period listed in 06 5 U.S.C. 2108(1), or who served in the Alaska Territorial Guard for 90 days or 07 more or whose service in the Alaska Territorial Guard was for a lesser period 08 because of injury or disability incurred in the line of duty; 09 (2) persons are eligible who were dependent upon a member of the 10 Alaska Territorial Guard or uniformed services [ARMED FORCES] or upon a 11 veteran, including persons who served in the Alaska Territorial Guard, eligible for the 12 benefits of this chapter at the time of the member's or veteran's death if the member or 13 veteran was a resident of the territory for one year before entry into service; 14 dependents must be unmarried and the deceased veteran or member of the uniformed 15 services [ARMED FORCES] must have been their chief means of support and they 16 must be either a widow, widower, minor child, or a mother, father, sister, or brother 17 incapable of self-support; dependents must be residents of the state at the time of 18 application and shall intend to remain residents in the state permanently; the rights of 19 minor children under this chapter may be exercised only if they have no surviving 20 parent and have an appointed guardian who may apply on their behalf for the benefits 21 of this chapter for their care, support, or education; 22 (3) a person who is eligible for veteran's benefits under the laws of any 23 other state or territory is not eligible for the benefits of this section unless the person 24 has lived in the state or territory for at least five years following the end of the person's 25 service in the Alaska Territorial Guard or release from active military service; a World 26 War II veteran who received a bonus under former AS 26.15.120 and former 27 AS 26.15.150 need not repay the bonus in order to qualify under the loan provisions of 28 this section; 29 (4) for persons otherwise eligible for the benefits under this section, 30 who did not return to the state or territory not later than one year after the end of the 31 persons' service in the Alaska Territorial Guard or separation from the service unless

01 prevented from doing so for medical, educational, or other valid purposes approved by 02 the Department of Commerce, Community, and Economic Development not later than 03 one year after the end of the persons' service in the Alaska Territorial Guard or 04 separation from the service, an additional requirement of four years' residence in the 05 state or territory before their entry into the service is imposed to entitle them to the 06 benefit provisions of this section. 07 * Sec. 11. AS 26.15 is amended by adding a new section to read: 08 Sec. 26.15.190. Definitions. In this chapter, unless the context indicates 09 otherwise, 10 (1) "uniformed services" means the armed forces of the United States, 11 the Commissioned Corps of the United States Public Health Service, and the National 12 Oceanic and Atmospheric Administration Commissioned Officer Corps; 13 (2) "veteran" includes a veteran of the Commissioned Corps of the 14 United States Public Health Service and the National Oceanic and Atmospheric 15 Administration Commissioned Officer Corps. 16 * Sec. 12. AS 28.10.181(d) is amended to read: 17 (d) Vehicles owned by veterans with disabilities, including persons disabled in 18 the line of duty while serving in the Alaska Territorial Guard, or other persons with 19 disabilities. Upon the request of a person with a disability that limits or impairs the 20 ability to walk, as defined in 23 C.F.R. 1235.2, the department shall (1) register one 21 motor vehicle in the name of the person without charge; and (2) issue a specially 22 designed registration plate that displays (A) recognition of the disabled veteran if the 23 applicant's disability originated from the applicant's service with the Alaska Territorial 24 Guard or the uniformed services [ARMED FORCES] of the United States; (B) the 25 international symbol of accessibility (the wheelchair logo); and (C) if the applicant is a 26 veteran, the Alaska and United States flags and red, white, and blue colors. A person 27 who is not otherwise qualified under this subsection, but who meets the qualifications 28 of a disabled veteran under AS 29.45.030(i), may register one motor vehicle without 29 charge, and the department shall issue a specially designed registration plate that 30 displays recognition of the disabled veteran that does not display the international 31 symbol of accessibility and does not carry with it special parking privileges. A

01 disabled veteran who otherwise qualifies for a registration plate under this subsection 02 may elect to receive a plate under (p) or (q) of this section for which the person is 03 otherwise qualified that does not display the international symbol of accessibility and 04 does not carry with it special parking privileges. A disabled person who otherwise 05 qualifies for a registration plate under (2)(B) of this subsection may elect to receive a 06 plate under another provision of this section for which the person is otherwise 07 qualified that does not display the international symbol of accessibility and does not 08 carry with it special parking privileges. For purposes of this subsection, proof of 09 disability may be provided by a person licensed as a physician or physician assistant 10 under AS 08.64 or as an advanced practice registered nurse under AS 08.68. 11 * Sec. 13. AS 28.10.181(l) is amended to read: 12 (l) Vehicles owned by Pearl Harbor survivors, former prisoners of war, Medal 13 of Honor recipients, and relatives of members of the United States uniformed 14 services [ARMED FORCES] killed in the line of duty. The department, upon receipt 15 of written proof, shall issue without charge special registration plates for one 16 noncommercial motor vehicle to a person who was on active military duty in Pearl 17 Harbor on December 7, 1941, who has been a prisoner of war during a declared war or 18 other conflict, as determined by the Department of Defense under federal regulations, 19 who is the recipient of the Medal of Honor awarded by the President of the United 20 States in the name of the United States Congress, or the spouse, parent, guardian, 21 brother, sister, or dependent of a member of the United States uniformed services 22 [ARMED FORCES] killed in the line of duty. The design and color of the Pearl 23 Harbor survivor, prisoner of war, Medal of Honor awarded by the President of the 24 United States in the name of the United States Congress recipient, or relative of a 25 member of the United States uniformed services [ARMED FORCES] killed in the 26 line of duty plates shall be solely within the discretion of the commissioner. 27 * Sec. 14. AS 28.10.181(p) is amended to read: 28 (p) Vehicles owned by veterans. The department, upon receipt of written proof 29 that the veteran is a sole or joint owner of a motor vehicle, shall issue special 30 registration plates for the motor vehicle to a requesting person who is a veteran or 31 retired veteran of the uniformed services [ARMED FORCES] of the United States.

01 The commissioner, after consulting with the person in the Department of Military and 02 Veterans' Affairs in charge of veterans' affairs, shall determine the design and color of 03 the veteran or retired veteran plates. 04 * Sec. 15. AS 28.10.181 is amended by adding a new subsection to read: 05 (ii) In this section, unless the context indicates otherwise, 06 (1) "uniformed services" means the armed forces of the United States, 07 the Commissioned Corps of the United States Public Health Service, and the National 08 Oceanic and Atmospheric Administration Commissioned Officer Corps; 09 (2) "veteran" includes a veteran of the Commissioned Corps of the 10 United States Public Health Service and the National Oceanic and Atmospheric 11 Administration Commissioned Officer Corps. 12 * Sec. 16. AS 28.15.111(c) is amended to read: 13 (c) At the request of an applicant, the department shall provide a veteran 14 designation and United States flag replica on a license identifying the driver as a 15 retired veteran or a veteran of the uniformed services [ARMED FORCES] of the 16 United States discharged under honorable conditions. The department may not charge 17 a fee solely for the designation. To receive a veteran designation, the driver shall make 18 available proof of veteran status that shows that the person is retired or discharged 19 under honorable conditions. With the approval of the applicant, the department shall 20 make available to the Department of Military and Veterans' Affairs the name and 21 address of a driver receiving a veteran designation under this subsection. The 22 department may charge a fee of $5 for replacement of a valid driver's license with a 23 new license with a veteran designation. A replacement license with a veteran 24 designation issued for $5 under this subsection must [SHALL] retain the expiration 25 date of the license it replaces. In this subsection, 26 (1) "uniformed services" means the armed forces of the United 27 States, the Commissioned Corps of the United States Public Health Service, and 28 the National Oceanic and Atmospheric Administration Commissioned Officer 29 Corps; 30 (2) "veteran" includes a veteran of the Commissioned Corps of the 31 United States Public Health Service and the National Oceanic and Atmospheric

01 Administration Commissioned Officer Corps. 02 * Sec. 17. AS 29.45.030(i) is amended to read: 03 (i) In (e) - (i) of this section, 04 (1) "disabled veteran" means a disabled person 05 (A) separated from the uniformed services [MILITARY 06 SERVICE] of the United States under a condition that is not dishonorable who 07 is a resident of the state, whose disability was incurred or aggravated in the line 08 of duty during [IN THE MILITARY] service in the uniformed services of 09 the United States, and whose disability has been rated as 50 percent or more by 10 the branch of service in which that person served or by the United States 11 Department of Veterans Affairs; in this subparagraph, "uniformed 12 services" means the armed forces of the United States, the Commissioned 13 Corps of the United States Public Health Service, and the National 14 Oceanic and Atmospheric Administration Commissioned Officer Corps; 15 or 16 (B) who served in the Alaska Territorial Guard, who is a 17 resident of the state, whose disability was incurred or aggravated in the line of 18 duty while serving in the Alaska Territorial Guard, and whose disability has 19 been rated as 50 percent or more; 20 (2) "real property" includes but is not limited to mobile homes, 21 whether classified as real or personal property for municipal tax purposes. 22 * Sec. 18. AS 36.30.321(f) is amended to read: 23 (f) If a bidder or offeror qualifies as an Alaska bidder and is a qualifying 24 entity, a five percent preference shall be applied to the price in the bid or proposal. 25 The preference may not exceed $5,000. In this subsection, 26 (1) "Alaska veteran" means an individual who is both a resident of the 27 state and a veteran; 28 (2) "qualifying entity" means a 29 (A) sole proprietorship owned by an Alaska veteran; 30 (B) partnership under AS 32.06 or AS 32.11 if a majority of the 31 partners are Alaska veterans;

01 (C) limited liability company organized under AS 10.50 if a 02 majority of the members are Alaska veterans; or 03 (D) corporation that is wholly owned by individuals, and a 04 majority of the individuals are Alaska veterans; 05 (3) "veteran" means an individual who 06 (A) served in the 07 (i) armed forces of the United States, including a 08 reserve unit of the United States armed forces; [OR] 09 (ii) the Commissioned Corps of the United States 10 Public Health Service or the National Oceanic and Atmospheric 11 Administration Commissioned Officer Corps; or 12 (iii) Alaska Territorial Guard, the Alaska Army 13 National Guard, the Alaska Air National Guard, or the Alaska Naval 14 Militia; and 15 (B) was separated from service under a condition that was not 16 dishonorable. 17 * Sec. 19. AS 36.30.321(k) is amended to read: 18 (k) In this section, "person with a disability" means an individual who 19 (1) has been determined to be permanently disabled by the 20 (A) United States Social Security Administration under 42 21 U.S.C. 423 or 1381 - 1383f (Social Security Act); 22 (B) teachers' retirement system under AS 14.25, the judicial 23 retirement system under AS 22.25, the public employees' retirement system 24 under AS 39.35, or the elected public officers' retirement system under former 25 AS 39.37; 26 (C) Federal Civil Service Retirement System under 5 U.S.C. 27 2107, 3323, and 8331 - 8351; 28 (D) federal employees' retirement system under 5 U.S.C. 8401 29 - 8480; or 30 (E) division of vocational rehabilitation in the Department of 31 Labor and Workforce Development using disability standards under 42 U.S.C.

01 1381 - 1383f (Social Security Act) for eligibility for certain state disability 02 programs; 03 (2) is receiving permanent total disability under AS 23.30 (Alaska 04 Workers' Compensation Act); 05 (3) has been discharged from the uniformed services [MILITARY 06 SERVICE] under honorable conditions and is certified by the United States 07 Department of Veterans Affairs as having incurred a 50 percent or greater disability 08 during [MILITARY] service in the uniformed services; or 09 (4) has served in the Alaska Territorial Guard and incurred a 50 10 percent or greater disability while serving in the Alaska Territorial Guard. 11 * Sec. 20. AS 36.30.321 is amended by adding a new subsection to read: 12 (l) In this section, "uniformed services" means the armed forces of the United 13 States, the Commissioned Corps of the United States Public Health Service, and the 14 National Oceanic and Atmospheric Administration Commissioned Officer Corps. 15 * Sec. 21. AS 38.05.067(e) is amended to read: 16 (e) In this section, "veteran" means a person with 90 days or more of active 17 service in the uniformed services [ARMED FORCES] of the United States who has 18 been honorably discharged or a person with 90 days or more of service in the Alaska 19 Territorial Guard. 20 * Sec. 22. AS 38.05.940(b) is amended to read: 21 (b) To be eligible for a discount under this section, a veteran shall submit 22 proof, as required by regulation, that the veteran 23 (1) is 18 years of age or older on the date of sale; 24 (2) has been a state resident for a period of not less than one year 25 immediately preceding the date of sale; and 26 (3) has served 27 (A) in the Alaska Territorial Guard for at least 90 days, unless 28 the service was shortened due to a service connected disability; or 29 (B) on active duty in the uniformed services of the United 30 States [U.S. ARMED FORCES] at least 90 days, unless tenure was shortened 31 due to a service connected disability or due to receiving an early separation

01 upon return from a tour of duty overseas, and has received an honorable 02 discharge or a general discharge under honorable conditions. 03 * Sec. 23. AS 38.05.965 is amended by adding a new paragraph to read: 04 (29) "uniformed services" means the armed forces of the United States, 05 the Commissioned Corps of the United States Public Health Service, and the National 06 Oceanic and Atmospheric Administration Commissioned Officer Corps. 07 * Sec. 24. AS 39.25.159(f) is amended to read: 08 (f) In this section, 09 (1) "consideration" means reviewing a person's entire application in 10 order to determine whether the person should be selected, rejected, or admitted to 11 further steps in the assessment or selection process; 12 (2) "disabled veteran" means a veteran who is entitled to compensation 13 under laws administered by the United States Department of Veterans Affairs, a 14 person who was honorably discharged or released from active duty because of a 15 service-connected disability, or a person who was disabled in the line of duty while 16 serving in the Alaska Territorial Guard; 17 (3) "member of the national guard" means a person who is presently 18 serving as a member of the Alaska National Guard and who has at least eight years of 19 service in the Alaska National Guard; 20 (4) "prisoner of war" means a person who has been a prisoner of war 21 during a declared war or other conflict as determined by the Department of Defense 22 under federal regulations; 23 (5) "veteran" means a person 24 (A) with 181 days or more active service in the armed forces of 25 the United States, the Commissioned Corps of the United States Public 26 Health Service, or the National Oceanic and Atmospheric Administration 27 Commissioned Officer Corps, and who has been honorably discharged after 28 having served during any period 29 (i) between April 6, 1917, and December 1, 1919, 30 between September 16, 1940, and December 31, 1947, between 31 June 27, 1950, and October 14, 1976, between August 2, 1990, and

01 January 2, 1992, beginning September 11, 2001, and ending on the day 02 prescribed by Presidential proclamation or by law as the last date of 03 Operation Iraqi Freedom, or during any time period listed in 5 U.S.C. 04 2108(1); or 05 (ii) in which the person was awarded a campaign badge, 06 expedition medal, the Purple Heart, or an award or decoration for 07 heroism or gallantry in action; 08 (B) who served 181 days or more in the Alaska Territorial 09 Guard. 10 * Sec. 25. AS 43.20.048(f) is amended to read: 11 (f) In this section, 12 (1) "disabled veteran" has the meaning given in AS 39.25.159; 13 (2) "seasonal position" means employment that is not intended to 14 continue through an entire calendar year but recurs annually; 15 (3) "veteran" means an individual who served in and was honorably 16 discharged from the 17 (A) armed forces of the United States, including a reserve unit 18 of the armed forces of the United States; [OR] 19 (B) Commissioned Corps of the United States Public Health 20 Service or the National Oceanic and Atmospheric Administration 21 Commissioned Officer Corps; or 22 (C) Alaska Territorial Guard, the Alaska Army National Guard, 23 the Alaska Air National Guard, or the Alaska Naval Militia. 24 * Sec. 26. AS 44.29.520(a) is amended to read: 25 (a) The Alaska Pioneers' Homes Advisory Board consists of 26 (1) five members appointed by the governor from among citizens of 27 the state; 28 (2) one member appointed by the governor who is a veteran of active 29 service in the armed forces of the United States, including the Alaska National Guard 30 or the Alaska Territorial Guard, or a veteran of active service in the Commissioned 31 Corps of the United States Public Health Service or the National Oceanic and

01 Atmospheric Administration Commissioned Officer Corps; 02 (3) one member who is the chair of the Alaska Commission on Aging 03 established in AS 47.44.200; and 04 (4) one member who is chair of the Alaska Veterans Advisory Council 05 established in AS 44.35. 06 * Sec. 27. AS 44.35.900 is amended to read: 07 Sec. 44.35.900. Definition. In this chapter, "veteran" includes a person who 08 served in the Alaska Territorial Guard, the Commissioned Corps of the United 09 States Public Health Service, or the National Oceanic and Atmospheric 10 Administration Commissioned Officer Corps. 11 * Sec. 28. AS 47.55.900 is amended to read: 12 Sec. 47.55.900. Definitions. In this chapter, unless the context otherwise 13 requires, 14 (1) "department" means the Department of Health and Social Services; 15 (2) "home" means 16 (A) the Alaska Pioneers' Home; or 17 (B) the Alaska Veterans' Home; 18 (3) "physical disability or other reason" means inability of an 19 individual to maintain a household without regular assistance in shopping, 20 housekeeping, meal preparation, dressing, or personal hygiene because of physical or 21 medical impairment, infirmity, or disability; 22 (4) "resident of the state" has the meaning given "resident" in 23 AS 47.25.430(a); 24 (5) "veteran" means a person who has been discharged from the armed 25 forces of the United States, including the Alaska National Guard or the Alaska 26 Territorial Guard, or from the Commissioned Corps of the United States Public 27 Health Service or the National Oceanic and Atmospheric Administration 28 Commissioned Officer Corps; the discharge [FROM THE ARMED FORCES] must 29 be other than dishonorable.
