00 CS FOR HOUSE BILL NO. 87(FSH) 01 "An Act relating to participation in matters before the Board of Fisheries and the Board 02 of Game by the members of the respective boards." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 39.52.120 is amended by adding a new subsection to read: 05 (g) Notwithstanding any other provision of this chapter, a personal or financial 06 interest in a matter arising directly from involvement of a member of the Board of 07 Fisheries or the Board of Game, or of an immediate family member of a member of 08 either board, in a business or organization relating to fish or game resources does not 09 disqualify a member of the Board of Fisheries or the Board of Game from deliberating 10 on a matter before the respective board. Before deliberating, the member shall disclose 11 the interest on the record. If a conflict is determined to exist, the member may not vote 12 on the issue. In this subsection, "immediate family member" means 13 (1) the spouse of the member; 14 (2) a person cohabiting with the member in a relationship that is like a
01 marriage but is not a legal marriage; or 02 (3) a parent, sibling, or child, including a stepchild and an adopted 03 child, of the member if the parent, sibling, or child 04 (A) resides with the member; 05 (B) is financially dependent on the member; or 06 (C) shares a substantial financial interest with the member.
