00 HOUSE BILL NO. 87 01 "An Act relating to participation in matters before the Board of Fisheries and the Board 02 of Game by the members of the respective boards; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 39.52.120 is amended by adding new subsections to read: 05 (g) Notwithstanding any other provision of this chapter, a public officer who 06 is member of the Board of Fisheries may deliberate on a matter before the board even 07 if the public officer, or an immediate family member of the public officer, has a 08 personal or financial interest in the matter because the public officer or immediate 09 family member holds a permit or license issued under AS 16.05, AS 16.40.261, 10 16.40.271, or AS 16.43. Before deliberating, the public officer shall disclose the 11 interest on the record. If a majority of the board members voting determine that a 12 conflict exists, then the public officer may not vote on the matter. 13 (h) Notwithstanding any other provision of this chapter, a public officer who 14 is a member of the Board of Game may deliberate on a matter before the board even if

01 the public officer, or an immediate family member of the public officer, has a personal 02 or financial interest in the matter because the public officer or immediate family 03 member holds a permit or license issued under AS 08.54 or AS 16.05. Before 04 deliberating, the public officer shall disclose the interest on the record. If a majority of 05 the board members voting determine that a conflict exists, then the public officer may 06 not vote on the matter. 07 (i) In this section, "immediate family member" means 08 (1) the spouse of the public officer; 09 (2) a person cohabiting with the public officer in a relationship that is 10 like a marriage but is not a legal marriage; or 11 (3) a parent, sibling, or child, including a stepchild and an adopted 12 child, of the public officer if the parent, sibling, or child 13 (A) resides with the public officer; 14 (B) is financially dependent on the public officer; or 15 (C) shares a substantial financial interest with the public 16 officer. 17 * Sec. 2. AS 29.52.120(g), enacted by sec. 1 of this Act, is amended to read: 18 (g) Notwithstanding any other provision of this chapter, a public officer who 19 is member of the Board of Fisheries may deliberate on a matter before the board even 20 if the public officer, or an immediate family member of the public officer, has a 21 personal or financial interest in the matter because the public officer or immediate 22 family member holds a permit or license issued under AS 16.05 [, AS 16.40.261, 23 16.40.271,] or AS 16.43. Before deliberating, the public officer shall disclose the 24 interest on the record. If a majority of the board members voting determine that a 25 conflict exists, then the public officer may not vote on the matter. 26 * Sec. 3. Section 1 of this Act takes effect immediately under AS 01.10.070(c). 27 * Sec. 4. Section 2 of this Act takes effect January 1, 2019.
