01 "An Act relating to the authority of the Department of Health and Social Services to                                    
02 take custody of a child and to remove a child from the child's home."                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 47.10 is amended by adding a new section to read:                                                  
05            Sec. 47.10.145.  Nonemergency custody.  In circumstances not involving an                                  
06       emergency under AS 47.10.142, the department may take nonemergency custody of a                                   
07       child under this chapter only by court order issued under AS 47.10.030 or 47.10.080.                              
08    * Sec. 2. AS 47.17.035 is amended by adding a new subsection to read:                                              
09            (f)  Nothing in this section authorizes the department to remove a child from                                
10       the child's home except as provided in AS 47.10.030, 47.10.080(c)(1) or (3),                                      
11       47.10.142, or 47.10.145.
