00                            SENATE BILL NO. 123                                                                         
01 "An Act relating to the penalty for the use of electronic devices while driving."                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1. AS 28.35.161(f) is amended to read:                                                                   
04            (f)  A person who violates (a) of this section is guilty of                                                  
05                 (1)  a violation [CLASS A MISDEMEANOR], unless any of the                                           
06       circumstances described in (2) - (4) of this subsection apply;                                                    
07                 (2)  a class C felony if the person's driving causes physical injury to                                 
08       another person;                                                                                                   
09                 (3)  a class B felony if the person's driving causes serious physical                                   
10       injury to another person;                                                                                         
11                 (4)  a class A felony if the person's driving causes the death of another                               
12       person.                                                                                                           
13    * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to                          
14 read:                                                                                                                   
15       APPLICABILITY. AS 28.35.161(f), as amended by sec. 1 of this Act, applies to                                      

01 violations occurring on or after the effective date of this Act.
